Rationale of fair use for "Love Is Blindness" sample
[edit]This is a sound sample from a commercial recording. Its inclusion here is claimed as fair use because:
- It illustrates an educational article that specifically discusses the song from which this sample was taken. The section of music used is discussed in the article in relation to the song's lyrics, musical and vocal style, and may contain part of the song's chorus.
- Speaking of the lyric "A little death without mourning / No call and no warning / Baby, a dangerous idea / That almost makes sense", Bono said ideas could be dangerous. This clip gives context to that sentiment by allowing the reader to hear it as it was expressed by the band.
- The bass was described by The Edge as a "low end bass throbbing effect". This clip contains that bass, aiding the reader in comprehending what he meant.
- Edge's guitar playing was described as a key element of the song; the latter portion contains some of this, which one reviewer described as "a mournful, ejaculatory guitar solo, stabbing out thick emotional blues notes that linger and then fall away like tears". This clip aids the reader in understanding that description.
- The clip runs for approximately 30 seconds; as this version of the song is 5:29 in length, this falls under the guideline of 10% or 30 seconds (whichever is less) maximum of the song's length (10% of 5:29 - or 329 seconds - is 32.9 seconds). The sample could not be used as a substitute for the original commercial recording.
- It is of a lower quality than the original recording.
- It is not replaceable with an uncopyrighted or freely copyrighted sample of comparable educational value.
- It is believed that this sample will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original recording.
- The audio sample is a copyrighted work. U.S. copyright laws apply to this work. Should a free or public domain sample be located, it should be used in place of this audio sample.
