The image depicts a subject of considerable notability, and for whom no free alternative can be found. The image that was used before for the article, of which I am the copyright holder, was outdated and did not accurately portray the subject. Additionally, I was reached by the person depicted to change that picture.
If you do contest this, please let me know and I'll respond as quickly as possible.

- Presumably the other freely licensed photograph accurately portrayed the subject at some point, no? Even if the other one is completely unsuitable for some reason, WP:NFCC#1 requires not only that no freely licensed alternative be available, but that no free replacement image could be created. Is there a reason why someone could not approach Berry and take a new freely licensed photograph of him?
- Alternatively, if the copyright holder of this image (which is not always the subject) wishes for it to be retained, they could release it under a free license by following the procedure listed at Wikipedia:Donating copyrighted materials. VernoWhitney (talk) 15:46, 19 December 2012 (UTC)[reply]
- Fair points. Here is my response:
- The copyright holder of the other image, myself, wishes for it to be deleted as I believe it is unsuitable. This should settle the unavailability of a free alternative.
- As to the ability to create a new, free picture that conveys the same encyclopedic content, it seems a bit difficult, if not impossible all together.
- I think I will contact the copyright holder of this image and work on permission from that angle as well.
