Recent Developments
As written, this section states that the President's Executive Order was intended to "protect landowners from over-reach" by the federal government. The neutrality of that statement was questioned. It is the previous administration's position that the rule did not expand USACOE jurisdiction, but was intended only to clarify what constituted "Waters of the U.S." I can personally attest that some USFWS personnel were treating seasonal drainages in upland areas as WOTUS as far back as 1990, so if there is over-reach, it is 25-year-old over-reach and a clarification was long overdue.206.219.255.152 (talk) 20:47, 2 March 2017 (UTC)
