The European Bars Federation (FBE - Fédération des Barreaux d'Europe) is an international organisation of lawyers, non-profit, which brings together the Bars and Law Societies within the Council of Europe (ttps://www.coe.int/).

The importance it has assumed over the years gives it the role of a true institution of the European Bar Association.

HISTORY

The Conference of the Great Bar Associations of Europe was founded in Paris on 27 June 1986. The founding Bar Associations were the Bar Associations of the cities of Amsterdam, Barcelona, Brussels, Geneva, Milan, Paris, Frankfurt and the National Bar Association of Portugal. Later the Krakow Bar Association was added. On 23 May 1992, in Barcelona, the Conference of the Great Bars and Law Societies of Europe was transformed into the Federation of Bars and Law Societies of Europe, opening to all Bars and Law Societies coming from a member state of the Council of Europe[1].

REPRESENTATION

Today the FBE represents about 250 European Bar Associations and over 1,000,000 lawyers. In Europe we know two institutions representing lawyers.

  • The CCBE (https://www.ccbe.eu) which brings together the National Bar Associations of the European Union.
  • The FBE represents the National Bars and Local Bars (including the Law Societies) of the States belonging to the Council of Europe.

In recent years, thanks to the joint vision of the Presidency of the FBE and the Presidency of the CCBE, the two representative institutions of the European Bar have strengthened their collaboration, synergy and representation in order to achieve more incisive results in the organisation of Justice and the Profession of Lawyer.

STATUS

The Federation of Bar Associations of Europe is a non-profit association with legal personality and subject to the law of the country of its registered office (now France) and its statutes, as updated.

The Federation of European Bar Associations has its registered office in Strasbourg, 3 rue du Général Frère 67000.

MISSION

The FBE is an independent international organisation of Bars for the protection of the essential principles of the lawyer's profession in Europe with the aim of fostering the synergy of all the Bars and Law Societies coming from the member states of the Council of Europe, forming and proposing a judicial policy that respects the principles of democracy and freedom proper to European culture.

The FBE aims to protect the rule of law, the independence of the judiciary, the rights of defence at national level, the defence of human rights in Europe and the world, and to defend the fundamental principles established by the European Convention for the Protection of Human Rights.

The FBE aims to represent the profession of lawyer to the European institutions; to guarantee to citizens and companies the professional services of free lawyers; to recognise the role played by the European Bars for the defence of freedom and rights.

The FBE is committed to ensuring total and concrete legal assistance to lawyers who are illegally persecuted because of the exercise of their professional duty. Of undoubted importance is the protection of the Defenders in areas where their activity puts them at risk.

Finally, the FBE has intervened in support of the Turkish Bar Association and, in particular, in Ankara.

Every year, the FBE Commissions and the FBE Chairmanship organise competitions dedicated to young lawyers who distinguish themselves in matters of special interest for the future of the profession and the protection of fundamental rights.

SYNERGIES

In recent years, thanks to the joint vision of the Presidency of the FBE and the Presidency of the CCBE, the two representative institutions of the European Bar have strengthened their collaboration, synergy and representation in order to achieve more incisive results for the better organisation of Justice and the profession.

The FBE has a partnership in UIA International Union of Lawyers (https://www.uianet.org/en).

The FBE, in June 2019, signed a memorandum of understanding with the International Criminal Court Bar Association (https://www.iccba-abcpi.org/home) in order to ensure representation and protection for lawyers who work before the International Criminal Court in Den Haag (NL). The FBE has therefore been called upon by the International Criminal Court to participate in the work on the drafting of the regulation of advocacy funded by the Court for parties (usually offended) who are not well-off.

The FBE has recently partnered with Re-Imagine-Europe (http://reimagine-europa.eu) to design the future of the European Union[2].

STRUCTURE

The bodies of the FBE are the General Assembly of members, which meets during the two annual congresses and elects the President, the Vice Presidents, the Secretary General and the Treasurer.

The FBE acts through the Presidency which consists of the President, two Vice-Presidents, the Secretary General and the Treasurer. All offices are elected for a non-renewable period of one year. Specific rules guarantee the representation of all European regions and cultures.

LANGUAGES

The Federation of Bar Associations of Europe recognises the national languages of all the countries represented within it. The official working languages are French, English, German, Spanish and Italian.

COMMISSIONS

The FBE is organised with standing committees and ad hoc commissions.

The former are dedicated to universal and basic aspects.

The second are dedicated to contingent or local needs. All the commissions work constantly to achieve the set objective and are hosted by member orders.
