Copy Right issues

My photos keep getting removed. I'm new. Can I use Flickr as proof?

Hey there - you let me a helpful comment on Harley Valentine. I am new so thank you so much for the advice. I really want to simplify getting photos up on his page as he's asked me to help him. One thing I was wondering: much of his photos he has uploaded to Flickr and on there you can see the license type he has picked. He enables free use of his images for non commercial and no remixing. Thanks for the reply. However, can you tell me how to fix this? I don't really understand why non commercial doesnt work since it's explicitly cool for anyone to use those images anywhere on the web. Dear Eeekster. I believe I'm trying to be cooperative here. But you're kind of just attacking me. I am asking what kind of licenses will work? The artist has given explicit permission for these to go live on Wikipedia. I commented out the image link in the article for now. I have uploaded and used non-free, reduced-resolution, images a number of times and never previously had any objections. I am not sure about how to get a 'free' photo or what kind of explanation about it being non-replaceable would be sufficient. I suppose I could try her e-mail link on her website and ask for a photo, but there is no guarantee that I would get a reply. If she were a building this would be an easy fix. The suggestion that I take a photo myself is extremely unhelpful as I will NOT put myself in a position that even remotely looks like I am a stalker. I think that the quote from the page on replaceability may be relevant here: In theory, a free image can be created of anything that exists or anyone living. But in practice, access to possible image subjects by all but a few people is sometimes limited, impossible, or prohibited. Wikipedia:Replaceability of fair-use images I have found a number of other photo of the subject, but I am not clear on the copyright on any of them and they are with few exceptions, rather unflattering candid amateur shots. Also, did you have any issues with any of the other criteria? Namely: Respect for commercial opportunities, Minimal usage, Minimal number of items, Minimal extent of use, Previous publication, One-article minimum, Contextual significance, and Restrictions on location. Also, at what point would this qualify as a derivative work? It was cropped from a larger image and the jpg quality setting was reduced to 75%. It meets the criteria of containing no more than about 100,000 pixels. (it is about half that at <51,000.) Also, there are WAY to many articles all over WP about this issue. For example, why is there both: Wikipedia:Non-free content criteria and Wikipedia:Non-free content. They seem to overlap a significantly. Nyth83 (talk) 01:13, 5 September 2014 (UTC)

It all boils down to her being still alive so a free photo can be produced. That eliminates the possibility of fair use. Eeekster (talk) 01:48, 5 September 2014 (UTC)

Give me a link to that page where you are quoting from. The word could is not an absolute. It only means a potential and does not speak to the issue of ...access to possible image subjects by all but a few people is sometimes limited, impossible, or prohibited.'. Logically, it not exclusive to could not. Death is not the only determining factor here. There are other situations where the subject would not be available. I still do not see that it is so black and white that it is impossible to have a fair use of a living person. If this were the case, why would there be pages and pages of criteria and limitations on the use of a fair use image for living persons? It would be a moot point to even discuss it. I know there have been many pages of discussion on this issue and I still have a lot of reading to do to catch up. Nyth83 (talk) 12:39, 5 September 2014 (UTC)
