The untold truth
[edit]The popular quote of police officers. it has become a norm for law enforcement officers to verbally or orally read out the provisions of Section 35(2) of the 1999 Constitution(as a mended) which states that 'Any person who is arrested or detained shall have the right to remain silent.. ... ' They do this without proper knowledge of such provisions, many of which are sometimes ignorant of which part or section of the Constitution support such assertion. In my solicitude I stumbled on the statutory act that established the police force of which they derive whatsoever power they exercise today,The Police Act 1967 unambiguously provides that a police officer must possess a good knowledge of the the law, surprisingly the onus is now shifted to the legal practitioners and not the police officers.Most police officers carry out arrest and unlawful detention without being fully abreast with the provisions of Section 35(1)(a)-(f),(emphasis on the proviso).
