Sleepy’s LLC is a privately owned four-generation mattress retail company founded in 1931 in Brooklyn, New York, with over 2,900 employees. There are over 1,000[1] retail locations in eighteen states from Maine to North Carolina and the Chicago, IL area, with eleven distribution centers throughout the US, and additionally Sleepy's is available nationally through www.sleepys.com and 1-866-Sleepys.[2][3]

In 1931 Louis Acker opens his first mattress store and employs his son, Harry Acker. The business was first incorporated in 1957 as Bedding Discount Center and in 1975 the name was changed to Sleepy’s.[4] The chain is now the second largest specialty mattress retailer[2] and largest bedding retailer in the United States.[5][6] In 1983 Sleepy’s trademarks itself as “Sleepy’s, The Mattress Professionals”. In 1993 Sleepy’s acquired Kleinsleep and in 1996 Mattress Discounters in New York and New Jersey. David Acker, Harry Acker’s son, became the president of Sleepy’s in 2001. Mattress Firm sleep chains locations in Connecticut and Massachusetts were acquired in 2003, and in 2007 Sleepy’s acquires the Rockaway Bedding chain.[7] In 2009 Sleepy’s acquired the assets of 1800mattress.com, including the domains 1800mattress.com and Mattress.com and a year later the Connecticut mattress specialty chain Better Bedding.[8] Equity firm Calera Capital partnered with Sleepy’s in 2013,[9] the same year as the New York State Pension Fund invested in Sleepy’s.[10] A year later, in 2013, Sleepy’s expanded into the Chicago market.[11]

In 1957 Harry Acker opens his first store and in 1977 Sleepy's opens its eighth store and relocates corporate offices and warehouse to a 20,000-square-foot (1,900 m2) space in New Hyde Park.[12] Nine years later, in 1986, Sleepy’s had outgrown the New Hyde Park location and relocates headquarters and distribution center to a 60,000-square-foot (5,600 m2) building in Port Washington, NY. Only eight years later, in 1994, the 75th store is opened and the corporate headquarters and distribution center moves to its third home in Bethpage, NY in a 150,000-square-foot (14,000 m2) building that is expanded in 1995 to 80,000 square feet (7,400 m2). In 1999 Sleepy’s opens its 169th store and in 2002 Sleepy’s built a new 211,000-square-foot (19,600 m2) warehouse in Robbinsville, NJ. When Sleepy’s acquired the Rockaway Bedding chain in 2007, 200 stores were added.[13] In the summer of 2009 Sleepy’s moved its headquarters and New York distribution facility to a newly constructed 500,000-square-foot (46,000 m2) building in Hicksville, New York. In October of 2014 Sleepy’s celebrated the opening of its 1,000 store.[14]

The first use of the logo with the Sleepy’s man in a red and white night shirt and cap was in 1976 and in 1978 the first televised Sleepy’s commercial starring President Harry Acker airs. In 1983 Sleepy’s trademarks itself as “Sleepy’s, The Mattress Professionals”, and in 1998 the 1-800-SLEEPYS, a toll-free service where people can consult with a “Mattress Professional” was established. A year later, in 1999, the Sleepy’s jingle is written and produced by Rich Lehman of RKL Productions and Jerry Plotkin of Headroom Digital Audio and Sleepy’s launches www.sleepys.com. Ten years later, 2010, Sleepy’s launches their ecommerce website.[15]

Sleepy’s carries Sealy, Serta, Simmons, Beautyrest, Posturepedic, Tempur-Pedic, My Side series mattresses, and 12 other brands of mattresses.[16]

Sleepy's salespersons attend “Sleepy's University” for three weeks upon initial employment.[17] The chain currently operates more than 1,000[18] stores primarily in the Northeastern, Mid-Atlantic and the Midwest, including Connecticut, Delaware, District of Columbia, Illinois, Indiana, Maine, Massachusetts, Maryland, New Hampshire, New Jersey, New York, North Carolina, Pennsylvania, Rhode Island, South Carolina, Virginia, Vermont, and West Virginia.

In 2009, Sleepy's was labeled as the fastest-growing furniture retailer in the US.[19]In 2012, Consumer Reports ranked Sleepy's last among 15 major mattress retailers it reviewed.[20][21][22]

Awards

In 2007, Sleepy’s was named one of Best Companies to Work for in New York by The New York State Society for Human Resource Management and Best Companies Group.[23] In 2008, Sleepy’s, in conjunction with RKL Productions, was awarded six Telly advertising awards for the ‘Inner Child’, ‘Newlywed’, ‘Tango’, and ‘Love Your Mattress’ television commercials.[24] ‘Tango’ was also awarded the highest Communicator advertising award, the Award of Excellence.[25] Most recently, in 2011, the Sleepy's Advertising team, won two awards, an Award of Distinction and Creative Excellence Retail/Specialty Store, at the Communicator Awards for the commercial titled ‘Animal Dream.’[26]

Community Awareness

Sleepy’s continuously participates in a multitude of charity events, both local and national. In recent years they have partnered with the Child Welfare League of America (CWLA) during the Thanksgiving 2009 season to provide a convenient drop-off location for new sleepwear for children and teens.[27] Sleepy's also participated in Tempur-Pedic Hugs Back campaign by purchasing $100,000 worth of their charity bears where all net proceeds went to the Pancreatic Cancer Action Network.[28] In August 2010, Sleepy’s was the host of the first ever Corporate American Cancer Society Relay for Life event in the Eastern Division and raised nearly $110,000 for the organizations mission.[29] During 2011 Sleepy’s participated among other things in United Way’s Stuff-A-Bus Campaign, Thanksgiving Food Drive and NYC Post Office’s annual holiday Be An Elf initiative to answer letters to Santa from underprivileged families.

In November of 2013 David Acker, Sleepy’s CEO & President, and Adam Blank, Sleepy’s COO, participated in the annual Covenant House Executive Sleep Out where they put themselves in the shoes of homeless youth and slept on the streets of NYC. [30] A year later, October 2014, Sleepy’s supported the American Cancer Society by Making Strides Against Breast Cancer[31]

Criticism and Controversy

In 2004, Sleepy's resolved a lawsuit filed by the New Jersey division of consumer affairs. The lawsuit alleged that Sleepy's misled consumers regarding their exchange policy, customer refunds, and advertisements. There were also questions about delivery of faulty merchandise and failure of delivery. Sleepy's agreed to pay $750,000 in costs and restitution to reach settlement. In addition to the payment the company agreed to clearer advertising, issuing refunds more willingly and improving customer service.[32]

In 2007, Sleepys agreed to pay $200,000 to resolve complaints and settle deceptive sales charges in NY. As part of the settlement, Sleepy's agreed to pay a total of $200,000, which includes restitution to consumers and penalties, as well as a commitment to new policies and procedures to achieve full compliance with local and State laws. The settlement marked a conclusion to the agency's extensive investigation into approximately 300 consumer complaints filed over the past three years through DCA or referred to the Department by other agencies including the New York State Attorney General's Office and the Better Business Bureau.[33]

In April of 2011 Sleepy’s was cleared by Connecticut Attorney General George Jepsen of charges regarding complaints of bed bugs infestations and accusations of re-selling used mattresses. The Attorney General's investigation found no evidence of bed bugs infestation of company warehouses or delivery trucks nor that the company re-sold used mattresses.[34]
