As the photo was taken around 1923, as was clearly used for publicity, it is a candidate for fair use. It will not be used again in BoxRec. The photo will be kept small, and the photo quality of the photo is not particularly good. It will be used only once.
Not replaceable with free media because (WP:NFCC#1)	Martin died in 1968, over forty years ago. Publicity photos this old, around seventy years, which had a copyright, would have had an expirationin within seventy years. The photo is eighty-six years old, as Martin quite boxing by 1930. The image is clearly the subject of the commentary of the article and is appropriate in this respect.
