****Generation of new copyright doesn't imply removal of old copyright, it may mean two copyright issues running concurrently. So a derivative of a copyrighted work such as a photograph of a sculpture may have copyright of the image itself (held by the photographer) and copyright of the sculpture, and to release the image freely may require the permission of ''both'' photographer and sculptor.
