411 PAIN, or 1-800-411-PAIN a Miami, Florida based company, is an American medical and lawyer referral service, which specializes in accident injury information services. The firm was established in 1996 by chiropractor Dr. Robert Lewin. The Florida Trend cites the firm as one of Florida's larger for-profit lawyer referral services, and Biotech Week cites 411 PAIN as one of America's "leading treatment and lawyer referral resources for people injured in auto accidents."[1][2]

Background and History

1996 is the year this company was established in Miami Dade Florida by chiropractor Dr. Robert Lewin.[3][2]

September 17, 2002, the USPTO formally registered the trademark 411 PAIN as U.S. Trademark Registration No. 2,621,497 .[4]

In a 2010 United States District Court Southern District of Florida case it states that they provide "assistance to victims of motor vehicle, slip and fall,work-related, and recreational accidents seeking medical, chiropractic and therapeutic care and legal advice by referring them to doctors and other health care professionals, scheduling appointments, and referring victims seeking legal advice to local attorneys."[4]

In May 2010, 411 PAIN filed suit in the United States District Court for the Southern District of Florida in Fort Lauderdale, Florida against 888-444-PAIN, Inc., and Accident and Wellness Centers, LLC. in a notable trademark infringement case, where they claimed infringement against their federally registered trademark 411 PAIN.[3]

On May 17, 2010, Judge Kenneth L. Ryskamp awarded a $5 million dollar judgement for 411 PAIN and a permanent injunction against its competitor, 444PAIN.[3] They issued the statement "411 PAIN puts other infringers in the same or similar category of services on notice that any use of the mark 411 PAIN , or any confusingly similar variations of “411″ and “PAIN” alone or in combination with any other letters, words, letter strings, phrases, or designs in commerce or in connection with any business or for any other purpose including, but not limited to, on web sites, in domain names, as names for business entities, or in mnemonic telephone numbers, they will be stopped."[5]

On December 7 2010, the USPTO formally registered the trademark 1-800-411-PAIN as U.S. Trademark Registration No. 3885749.[6] In advertising, the company is known for its trademarked phrase, "After 911, Call 411, 1-800-411-PAIN." [5] Their radio and television-based commercials usually feature actors portraying police officers or emergency workers urging motor accident victims to contact both a lawyer and doctor as soon as possible after the crash after first calling 911.[1]

In 2011, the firm introduced an iPhone application which provides car crash victims with the opportunity to "catalog and report an accident to 411 PAIN , including pictures of the vehicles involved, photos of drivers' licenses, insurance cards and license plates, and record any bodily pain you have."[1]

Humanitarian issues

The firm has been involved in numerous charitable schemes, especially in education.[3] It has been involved in the Read and Rise program in low income schools in both Miami-Dade and Broward Counties, donating $60,000 to the cause.[2] It also funded $60,000 for what is known as the 411 Pain Cash for Teachers Contest, which "awards $1,000 per month to a teacher in each county, culminating with a May grand prize of $11,000 for each district."[2] In March 2011 they donated $2,120 to Miami-Dade Schools Superintendent Alberto M. Carvalho and Martha Harris, principal of Dr. Henry W. Mack Elementary School in Miami,FL to fund a Scholastic Book Fair in which $5 gift certificates were given to children to buy books of their choice.[2] They also organizes the 411 Pain Bowl between schools in southern Florida. The company is also active in the campaign against bullying in schools and sponsors The Prevention Team, an anti-bullying organization.[7][8] On September 29 2011, 411 PAIN, along with Romance 106.7FM, Budweiser, Miccosukee Resort & Gaming and Walgreens, organized a Latin music concert in Miami Florida named "Una Copa con Romance", attended by some 1500 people and artists such as Charlie Zaa.[9] In October 2011, 411 PAIN sponsored basketball coach Isiah Thomas's Mary's Court foundation and the "South Florida All-Star Classic" charity match featuring LeBron James, Dwyane Wade, and Chris Bosh, held at the S. Century Bank Arena on the Modesto Maidique Campus of Florida International University.[10] The company also promotes Halloween safety by giving out glow sticks.[11]
