Employsure is an Australian-based business support company, specializing in Industrial relations.
The firm has been the subject of a number of legal controversies in Australia, including a prosecution by the ACCC for a breach of the Australian Consumer Law. [3][4]
History
Employsure was registered as a company in 2011.[5] It claims to be the largest in its sector with over 20,000 clients in Australia and 800 employees.[6]

The company is a signatory to the Australian Supplier Payment Code, overseen by the Business Council of Australia.[7][8]
Workplace research and advocacy
Employsure has conducted surveys of workplace harassment in Australia.[9]
The company has been critical of decisions by the Federal Court that have resulted in increased pay for apprentices in Queensland. [10]
Misconduct allegations & legal controversies
The company has been involved in a number of legal controversies. In 2015 the company was found to have unfairly dismissed one of its employees,[11][12] and in 2017 lost a lawsuit with a customer attempting to enforce a lock-in contract.[13]
Misleading & deceptive conduct
On July 2017, the Fair Work Ombudsman released a statement regarding complaints from members of the public claiming to have been misled by the web address "www.fairworkhelp.com.au" owned and operated by Employsure. The Fair Work Ombudsman stated that it is not affiliated with any commercial providers of advisory or workplace relations, and that it provides tools, advice and services to employers, employees and members of the public free of charge.[14][15]
In 2018, the ACCC commenced prosecution against Employsure for having engaged in misleading and deceptive conduct.[3] The ACCC alleged that Employsure had targeted small businesses who were seeking the free workplace relations helpline operated by the Government. According to the prosecution, its primary objective was to sign these businesses up to long-term contracts with on-going fees. The ACCC also alleged that Employsure engaged in unconscionable conduct towards four small businesses between August 2015 and June 2018.[4]
