Image:GuernicaGernikara.jpg is a picture by User:Error of a tiled wall reproducing Guernica (painting). It was uploaded as GFDL and Cc-by-sa-2.0. User:Saperaud has changed it to fair-use ("you can't make an image and think you have the copyright on what you photographed"). I find as well commons:Commons:Licensing#Spain:
Exceptions to this (that may be useful in commons) are:
  • The pieces of work situated permanently in parks, streets, squares and other public ways can be reproduced, distributed and communicated freely by using paintings, drawings, photographies and audiovisual procedures.
Another thing is whether the Gernika authorities had the right to commission a copy of the painting.
