Principes généraux du droit[edit]

This page is linked from the French page fr:Principes généraux du droit. Principle of law also links here.

FWIW, the Statute of the International Court of Justice[1] talks of "les principes généraux de droit reconnus par les nations civilisées" in the French version and in the English version "the general principles of law recognized by civilized nations" (Art 38 1c). Fundamental Breach and Fundamental Term[edit]

Willes, also called the Doctrine of Fundamental Breach as Doctrine of Fundamental Term. This may be a Canadian usage only. Wiki explains how a contract be voided if the fundamental term can be discovered goes to the root of the contract and is termed Rule of Law.

Implied repeal[edit]

Are implied repeals a legal doctrine? Could perhaps be added to the table of examples. Someone with more knowledge could perhaps weigh in? — Preceding unsigned comment added by 193.69.210.218 (talk) 17:51, 9 March 2018 (UTC)[reply]

Legal principles[edit]

Legal principles redirects here, but principle and doctrine are two different things. The first is the idea of a law in philosophical terms, but doctrine simply refers to the codifcation of some principle or some de facto status of law. Principle has the problem of being of ideal form, but thats not a problem with the idealists, who work in ideals and honor that doctrines be in accord with principles and not just de facto statues. -Inowen (talk) 03:15, 12 March 2018 (UTC)[reply]
