"Deemed unlikely" assertion challenge[edit]

I challenge the verifiability of this sentence in the article (regarding civil lawsuits against activists who deflate tires in protest against SUVs):

Success in these civil law cases is deemed unlikely.

"Deemed" means to come to a conclusion. Who has deemed their success to be unlikely? Unless there's a source, this rather unusual assertion should be removed. Even if one dislikes SUVs, and even if one believes that SUVs harm people, it seems reasonable that a person would be likely to prevail in a civil action against a tire-deflater on trespass grounds.
