Image:Fredric March 1 in Parade of the Award Nominees 1932.jpg is being used on this article. I notice the image page specifies that the image is being used under fair use but there is no explanation or rationale as to why its use in this Wikipedia article constitutes fair use. Public Domain Status

With Mickey Mouse set to enter in a few days, I think we might want to litigate the public domain status of this.

Interestingly, the short features a physical copyright notice, but it lacks a year which was also required at the time. Additionally, it seems that no registration or renewal was ever published for the short. I checked the initial logs from 1931-1934, as well as the renewals for 1959, 1960, and 1961 and I saw no mention of this short.

That leads us to if it is considered published or not, and that can get tricky. If published it would be 95 years after publication, and it would be 2028 when it enters the public domain.

If we consider it to be unpublished then we have to make a few more assertations. If we take the 2001 year as publication of the short on the DVD, then it might be public domain in 2037 since Walt Disney is the director of the film. And that is 70 years after his death.

I believe this should count as an unpublished work since it was never given a distributor and was only shown in the private 1932 awards ceremony. Because of this it will be public domain in 2037 as an unpublished work by Walt Disney. SDudley (talk) 21:29, 1 January 2024 (UTC)[reply]
Also it seems that the primary animator is credited as Joe Grant who died in 2005. Under the rules of him as the author of the literal animation this short would not be public domain until 2076. SDudley (talk) 15:26, 4 January 2024 (UTC)[reply]
