Loss of Protection

[edit]

Suggested section for loss of section 7 protections to be added under "Concerted Activity". Some initial research:

  • Indefensible loyalty (Jefferson standard)
  • Slow down/sabotage (Elk Lumber) 91 NLRB 333 (1950)
  • Partial strikes - illegal behavior (non case specific find secondary source)
  • Intermittent strike (NLRB v. Fansteel Metallurgical Corp., 306 U.S. 240 (1939))
  • Picket Line misconduct - Lion Elastomers, LLC, 372 NLRB No. 83 (May 1, 2023) (Atlantic steel test of misconduct)
