It's only "free" as in "you don't have to pay for it", not as in "freely redistributable". See the image page. Besides, that site cannot even spell "copyrighted" correctly [1], I wouldn't trust them on such issues. Lupo 15:05, 28 September 2005 (UTC)[reply]

Sending a boilerplate request for permission is basically a good idea, but there are two problems you should be aware of:
  1. http://www.desktopia.com/ most probably doesn't own the copyright on Image:Sydney1.jpg. You would have to find out where that image originally came from, figure out who owns the copyright, and then ask them.
  2. A simple permission for use on Wikipedia is not good enough. It must be a "no strings attached" permission for free redistribution, including for commercial purposes, and including the redistribution of edited images, subject only to proper attribution of the author.
Finding images of celebrities that we can use isn't easy. Good starting points to find out about Wikipedia's image policies are Good starting points are the Copyright FAQ, Wikipedia:Copyrights, Wikipedia:Fair use, Wikipedia:Publicity photos (in work), and also the Copyright primer from the University of Texas.
On these other images you mentioned:
  • Image:Yana Cova.jpg is claimed to be a "promotional photo". I dispute this "fair use" claim because using a hi-res image is not "fair use". If it was thumbnailed to 200px, I would agree that we could consider the use of this image in the article on Jana Cova a "fair use". For fair use, the image should not be larger than necessary. It is used as a 200px image on the article page, so we don't need a larger version. This is to make sure that our use does not diminish the market value of the original, which is one of the four points of fair use. Other points important to remember about "fair use": any "fair use" is with respect to the article the image is used in, and any image tagged with the generic {{fairuse}} tag should have a detailed fair use rationale addressing the four points I mentioned above.
  • Image:Penny Flame 1.jpg seems to be barely OK now that someone has reduced its size, although it is still slightly larger than absolutely necessary.
  • Image:Sylvia_Saint_001.jpg is OK because the copyright owner (bomis.com, owned by the founder of Wikipedia) has agreed to license the image under a free license, namely the GFDL.
Now what does all that mean for Sydney Moon? I'd say if you can find an official site (i.e. one where it stands to reason that they do own the copyright) having a decent promotional or publicity shot of her (no porn, please :-), e.g. from Playboy, you could upload a 200px thumbnail and state the source URL and tag it with {{promotional}}, and it would be fine, IMO.
