I have noticed that the Department of Main Roads (New South Wales) logo that you uploaded in December 2020 was deleted on Commons last month. I am just wondering if you remember where you sourced it from, as I also intend to upload the DMR logo on English Wikipedia (not Commons). I just want to see if the logo you found back then will be the best logo to be reinstated on the DMR page, otherwise I will use DMR logos I can find on reports from the 1980s on Open Gov NSW. Unacceptable use of non-free content. Wikipedia's [content project page] specifically cites "A photo from a press agency or photo agency (e.g., AP or Getty Images), unless the photo itself is the subject of sourced commentary in the article." as being an unacceptable use of non-free content. In order for the photograph to fulfil the 'subject of sourced commentary' exception, text would need to be written referring specifically to the photograph itself (not the content of the photograph), which would certainly be non-encyclopaedic due to sheer lack of notability. Even if the aforementioned issue was not a factor, the uploader's current justifications for fair use are extremely vague and inappropriate. The 'purpose' justification is invalid due to the 'subject of sourced commentary' issue mentioned above (again, the photograph itself must be the subject of commentary, not the content of the photograph). The 'minimality' justification cited does not address the 'minimal use' of the image at all. The 'commercial' justification is totally invalid as the photograph is still at full resolution (cropped, but still full resolution) and NSW Roads and Maritime charges in excess of hundreds of dollars for editorial use of the image at commercial rates, therefore certainly impacting the commercial viability of the photograph. Given that several of the ten required criteria for non-free use quoted on the [content criteria page] are invalid due to the reasons mentioned above, I am requesting a speedy deletion of this image due to copyright infringement.

It should be mentioned that any further attempts to upload and link this particular image will be reported to the Administrators' noticeboard as per the repeat copyright infringement guidelines., as I have already had to do this once before with the same Getty Images photograph, only that time it was blatantly watermarked with zero fair use justification. 202.172.126.228 (talk) 15:31, 28 October 2021 (UTC)[reply]
