With Senator Karen Gillmor resigning from her seat, Burke had been named as a possible successor.[3][4] Up against ten others who were vying for the seat, Burke was seen as one of the favorites to obtain the seat. Ultimately, it was announced by Tom Niehaus that Burke would indeed be appointed to fill the vacancy.
He was sworn into office on July 13, 2011. Currently, he is on the committees of Agriculture, Environment and Natural Resources; Health, Human Services and Aging (as vice chairman); Highways and Transportation. He also is serving on the Unified Long-Term Care System Advisory Workgroup; the Joint Legislative Committee for Unified Long-Term Services and Supports; and the Joint Committee on Agency Rule Review.
