Refund?

The check was never accepted by Pepsi. On or about May 7, 1996, defendant's fulfillment house rejected plaintiff's submission and returned the check, explaining that:

The item that you have requested is not part of the Pepsi Stuff collection. It is not included in the catalogue or on the order form, and only catalogue merchandise can be redeemed under this program.
The Harrier jet in the Pepsi commercial is fanciful and is simply included to create a humorous and entertaining ad. We apologize for any misunderstanding or confusion that you may have experienced and are enclosing some free product coupons for your use.

Settlement and Aftermath?

I have no authoritative source (currently), but I remember there was more to this story -- Pepsi gave the kid a sizeable scholarship, donated some money somewhere (possibly the $700K), and updated the Harrier's value to "7 BILLION PEPSI POINTS" or some similar. Anyone else remember this? Stands apart from mere trivia for the plaintiff's (apparent) 'gain,' and possible corporate precedent. I'll see what I can dig up. John Leonard

The plaintiff must have had a few bob to hire lawyers and take Pepsi to court - and then again on appeal - just for a joke. Apparently he was 21 at the time so he must have either been very successful very early or it was his parents' money, which amkes me wonder how happy they were for him to spend their money on a humorous lawsuit.
