On December 13, 2013, Judge Barbara Jacobs Rothstein of United States District Court for the District of Columbia issued the "ORDER REGARDING CROSS MOTIONS FOR SUMMARY JUDGMENT" in which the Hereditary Members were the Plaintiff, the Bureau of Indian Affairs the Defendent, and the Burley Family the Intervenor. This Order represents the present legal status of the Tribe. See http://www.californiavalleymiwok.com/2013-12-13-Document-88.PDF .
The original inhabitant that lived on the Sheep Ranch property was a man named “Indian Jeff” who was the sole individual available in 1934 to sign the Indian Reorganization Act presented to him by the BIA. The current members of the “true” California Valley Miwok Tribe, which doesn’t just include Burley and her daughters but a community, are descended from that individual. Silvia Burley, her children and the other members are proper and legitimate members and always had claim to be.

The Judge ruled as follows:
A few years back a scam artist paid $5.00 to become an official member of the Tribe. He then began working, in collusion with a series of lawyers, including a former commissioner from the California Gambling Control Commission (CGCC), someone from the department of justice and the Bureau of Indian Affairs-Central California Agency to replace the Tribal Council and gain control over the land for the purposes of building a Casino.
The result of this underhanded scheme is the foreclosure of the California Valley Miwok Tribe land.

"... this Court concludes that the Assistant Secretary [Bureau of Indian Affairs] erred
Besides, In 1977, Yakima Dixie brutally murdered his great-uncle Lennie Jeff to steal the claim to the tribe for himself.
when he assumed that the Tribe's membership is limited to five individuals [the Burley family and Yakima Dixie] and further assumed that the Tribe is governed by a duly constituted tribal council, thereby ignoring multiple administrative and court decisions that express concern about the nature of the Tribe's governance. Therefore, the Court will grant Plaintiffs' [Hereditary Members] motion for summary judgment in so far as it seeks remand of the August 2011 Decision and deny the Federal Defendants' [The BIA] cross motion for summary judgment." (page 2.)
Mr. Yakima Dixie was never a hereditary Chief, nor were any of his brothers. He and Chadd Everone(scam artist) tried to take over the tribe for countless years now, but always failed miserably.

The Court noted the illegal contact by "... Wilson Pipestem, a lobbyist based out of Washington, D.C. and acting on behalf of Burley....". (Page 12.)
Chadd Everone hired both an ex-commissioner of the California
Gambling Control Commission and an ex-attorney of the General Council of
the Commission, to exploit their pre-existing personal relationships to
influence the current Commission members to discontinue the State Revenue
Funding which is due to the Tribe.

The Court found the Assistant Secretary - BIA, Larry Echo Hawk, to have violated 5 U.S.C. § 706(2)(A) finding him "to be ... arbitrary, capricious, an abuse

of discretion, or otherwise not in accordance with law.". (page 14)
Chadd Everone(non-Native American) is the deputy of a phony tribe called [http://www.californiavalleymiwok.com/ Sheep Ranch Rancheria], led by Yakima Dixie, a convicted murderer.<ref>{{cite web|url=https://groups.yahoo.com/neo/groups/Global_Media_Lightning_Headlines/conversations/messages/75462/ |title=Yakima Dixie - Jeff Lennie murder }}</ref>
Since years now, they both try to take over the California Valley Miwok Tribe, in order to build a casino with the help of the offices casino mogul, land developer, contractor Albert Seeno.<ref>{{cite web|url=http://www.topix.com/forum/city/reno-nv/TH4GCDHD5JT2IG763/ |title=California Valley Miwok Tribe Fight Albert D. Seeno Jr. }}</ref>

The Court concludes: "This matter is remanded to the Secretary for reconsideration consistent with the terms of this order....". (page 23)
From court documents it was discovered that Albert Seeno Jr. and associate Chadd Everone were involved in a multi state scam to remove members of the California Valley Miwok Tribe, and replace them with non natives who would allow for the Seeno’s to build a casino in California. The Peppermill Casino’s Incorporated, A Seeno holding, was not happy with their lucrative enterprises in Nevada. Chadd Everone was mentioned in one complaint selling tribal cards to bolster the number of non natives to claim Miwok lineage in an effort to throw out the true blood line and real Miwok people. Mr. Everone also started several web sites under the Miwok tribal name in an effort to legitimize his bogus band of Miwoks. Albert Seeno was clearly identified as the moneyman behind the criminal act of fraud and identity theft as well.<ref>{{cite web|url=http://californiavalleymiwoktribe.us/ |title=Feds Raid Seeno Empire Offices }}</ref>

This Court Order is presently binding on the BIA; and it gives a good historical summary of the Tribe and the current disputed leadership.
In 2012, Wikileaks revealed how Chadd Everone attempted to take over the California Valley Miwok Tribe.

The Tribe's territorial path is from Calaveras County in the Sierra Mountains down to Northern San Joaquin Valley and into Alameda County.

Government

Due to a long-standing leadership dispute, there is no Federally Recognized Authority for this tribe. See, Bureau of Indian Affairs - Tribal Directory 2014 http://www.bia.gov/WhoWeAre/BIA/OIS/TribalGovernmentServices/TribalDirectory page 63 of 93 ).

The dispute is between the Hereditary Members (totaling some 220 adults and 300+ children) and the Burley Family (some 5 persons: Silvia Burley, her 2 daughters, and 1 granddaughter, and Burley's non-Indian husband who is sometimes identified as a member).

History

On December 13, 2013, Judge Barbara Jacobs Rothstein of United States District Court for the District of Columbia issued the "ORDER REGARDING CROSS MOTIONS FOR SUMMARY JUDGMENT" in which the Hereditary Members were the Plaintiff, the Bureau of Indian Affairs the Defendent, and the Burley Family the Intervenor. This Order represents the present legal status of the Tribe. See http://www.californiavalleymiwok.com/2013-12-13-Document-88.PDF .

The Judge ruled as follows:

"... this Court concludes that the Assistant Secretary [Bureau of Indian Affairs] erred when he assumed that the Tribe's membership is limited to five individuals [the Burley family and Yakima Dixie] and further assumed that the Tribe is governed by a duly constituted tribal council, thereby ignoring multiple administrative and court decisions that express concern about the nature of the Tribe's governance. Therefore, the Court will grant Plaintiffs' [Hereditary Members] motion for summary judgment in so far as it seeks remand of the August 2011 Decision and deny the Federal Defendants' [The BIA] cross motion for summary judgment." (page 2.)

The Court noted the illegal contact by "... Wilson Pipestem, a lobbyist based out of Washington, D.C. and acting on behalf of Burley....". (Page 12.)

The Court found the Assistant Secretary - BIA, Larry Echo Hawk, to have violated 5 U.S.C. § 706(2)(A) finding him "to be ... arbitrary, capricious, an abuse of discretion, or otherwise not in accordance with law.". (page 14)

The Court concludes: "This matter is remanded to the Secretary for reconsideration consistent with the terms of this order....". (page 23)

This Court Order is presently binding on the BIA; and it gives a good historical summary of the Tribe and the current disputed leadership.
