The Clear Day case is a case of abuse of minors in a resocialization facility for drug addicted adolescents, Clear Day (Slovak: Čistý deň) in Galanta.

The Case

This incident came into public knowledge in september 2016, after being published in the blog of MP Natália Blahovová [sk] (SaS)[1][2] In the blog called „Requiem for sexually abused girls" she described the sexual abuse of several minors in the facility.[3] According to the court sentencing, the sexual abuse occurred in February 2014. [4]In a later interview Blahová describes the situation of the victims:„Wood was being split on them there, they were cleaning pools with toothbruses, they were starving, they were running in pajamas on the street, their feet were tied together, in the solitary confinement."

The effects of the case

Natália Blahová in April of 2017 initiated withdrawal of Minister of Labour, Social Affairs and Family, Ján Richter (SMER-SD). The withdrawal was initiated because the initial ministery declined to withdraw accreditation of Clean Day despite recommendations.[1] At the assembly Natália Blahová had a nearly 3 hour appearance where she cited the alleged Clear Day facility's clients' statements. In the end, the minister was not recalled at the night meeting: 57 deputies were in favor, 68 were against, and two did not vote. vali.[5]

The prime minister's adviser at the time, Erik Tomáš (then for SMER-SD), was also involved in the case, he gave the leader, Mr. and Mrs. Tománkovec, "PR management lessons".

In June 2018 ministers of Trnavský samosprávny kraj canceled the renting of of one of the Clear Day`s building contract and lending of the second building. Clear Day refuses to return the lended building, TSK wants to defend itself through legal means.[6]

As a result of this affair, as of August 31, 2019, the accreditation of the Ministry of Labour, Social Affairs and Family was definitively withdrawn from the non-profit organization Clear Day.[1]

According to information from February 2020, former director Peter Tománek worked in the organization Cor Centrum in Krupina. She is dedicated to adult clients.  According to the findings of Natália Blahová, the ministry did not check whether Tománek fulfills the legal obligation of integrity. There were also doubts about his mental capacity. Blahová points out that Cor Centrum has also worked with juveniles in the past.[7]

In May 2021, the first hearing day of the Clear Day organization's lawsuit against Natália Blahová for "unauthorized interference with the good reputation of a legal entity" took place. Clear Day demands compensation of 60,000 euros (US$70,962) and an apology.[6] As of June 2021, Blahová faced five lawsuits, one of which was already rejected by the district court, but there was the possibility of an appeal. According to the judge, Blahová could not damage the reputation of the establishment, because it had already had a bad reputation before. Blahová's accusations were of a "harassing nature".

The leaders of the center have not been punished yet.[8]

Convictions

The first convicted was the facility's psychologist, who was sentenced to a suspended sentence of 32 months with a 3-year probationary period.[9]

The second convicted was the facility's cook Jakub Filo, who was sentenced to 5 years and 4 months in prison in June 2021 for sexual abuse. The director of Clean Day, Peter Tománek, later admitted that the incident took place, according to him, it was a voluntary "goodbye sex".[9] The cook did not report to the prison by June 2021 and a search was launched for him.
