Righthaven LLC v. Democratic Underground LLC and David Allen

Background[edit]

Democratic Underground is a website supporting an online community discussing primarily politics but also other topics. Users post content to a variety of forums. They are cautioned[1] to follow specific guidelines in order to comply with fair use doctrine and avoid copyright infringement (and its legal ramifications) . The website is moderated by volunteers.[2]

On or about May 13, 2010, a user posted an article concerning support given to Sharron Angle. It linked to an article published in the online version of the Las Vegas Review-Journal and contained a brief excerpt.

On August 10th, 2010, Righthaven LLC filed a lawsuit [3] against Democratic Underground claiming copyright infringement.

On September 28th, 2010, the Electronic Frontier Foundation (EFF), posted an Answer and Counterclaim.[4] DU and David Allen are being represented by the Electronic Frontier Foundation (EFF), Winston & Strawn LLP, and attorney Chad Bowers.
