Herman was defeated by Triangle Choke at 2:27 of the second round. Maia had gained the mount position with a Triangle Choke still in place, as he unloaded several punches to the face of Herman. The referee then stopped the fight due to Herman being unconscious. It was hailed as the Submission of the Night.

Herman most recently fought at [[UFC Fight Night 15]] on September 17, 2008, losing a close split decision to [[Alan Belcher]]. Although he was on the losing side of the stand-up battle early on, some believe Herman's success with take downs in rounds 2 and 3 should have gave him the edge on the scorecards.
