Italian photographs are copyrighted for 20 years from creation. In USA there is also a few extra requirements, for example that the photo must have been published before 1 March 1989. For a famous person who died in the 1940s, it seems very unlikely that there would be no photo which was published before 1 March 1989. Therefore, the photo appears to violate WP:NFCC#1. OK, so this is a first for me. I don't see why it can't be included as fair use. All photos of this man are likely to fall under copyright. As I said before, there seems to be only photo circulating in public.Jacqke (talk) 16:32, 1 October 2013 (UTC)[reply]
If you can find a photo which was first published in Italy and published before 1 March 1989, then that photo should be in the public domain in Italy. I find it extremely unlikely that no such photos would exist of a famous Italian man who died in 1949. For example, there were presumably some photos which were published in Italian newspapers during the person's lifetime.
