- Responding to complaints here and on the image's Talk page, I have found this image's filename to be both (at best) wildly inaccurate and potentially inflammatory. The person being executed in the foreground is not, in fact, a political dissident, but a convicted murderer, according to this article.
- Since the image is still valuable in the context of the articles in which it appears, I have uploaded a new copy of the image to the more neutrally-named File:Execution in China.jpg and used it to replace both appearances of the previous image in the Encyclopedia, at Human rights in the People's Republic of China and Capital punishment in the People's Republic of China.
- This fair-use image is now not only inaccurately named, but redundant and orphaned as well, and should be deleted. --Dynaflow babble 00:37, 14 December 2009 (UTC)[reply]
- Delete - untruthful image title, the woman was a double murderer. (If the government had executed her after her first conviction for murder, her second victim would probably still be alive today.) - Delete however - Since when was the Chinese government considered a Reliable Source? They have a state run media. Oh... and by the way the article linked to by Dynaflow is off a pornography website, sankakucomplex. The link to the Laogai Research Foundation is broken. The link to the site saying its 'drug dealers'... also broken. Someone says that the Laogai link text doesn't describe the person as a 'political dissident'. However, someone needs to get a lot more sources before they claim they know what this is. Oh and as for 'double murder'... the article you link to even says that the first murder was what in some US courts would be called self defense. What we have here is a paucity of facts. A good beginning would be to analyze the photos and try to figure out where it happened by looking at terrain and buildings. Reading the chinese text would also help. Looking at the uniforms could give the rank of the officers involved, and possibly reveal information about location or what kind of unit they were. - The source seems to be obscure but that may not preclude the possibility of using the images under the fair use claim. The article where the image has been used discusses about a military operation conducted to flush out religious extremist, the article has a cause/reason for the operation section, this image clearly illustrates the militants brandishing SLRs and singe shot rifles along with considerable number of cartridges, the image centrally focuses on Bhidarwale one of the top militant leaders who had allegedly started the siege of the temple complex and had amassed a cache of weapons, the government used this reason to storm the temple with tanks and heavy machine guns, thus this image would provide a pictorial representation of the arming of the militia that has been one of the reasons of the hostilities. This image would qualify for fair use as the image resolution is low and this would not prevent the original copyright holder to commercially exploit the IP, further the image is essential to give readers a complete understanding of the reasons behind the operation, hence the article should be allowed to use under fair use clause. - Whether the image in question is in PD is debatable, however about the fair use of the image in the article on Operation Blue Star, there is little uncertainty. The article is on a military operation to flush out militants from a place of worship. The image illustrates the defensive position taken up by military about 150 m from the main compound. At least a third of the article speaks directly on the nature and progress of the military operation, this image not only captures a moment of battle it also sheds light on the nature of such operation; earlier an image of a light tank used directly in the mission was put up in the article but due to problems relating to fair use issues it was deleted, if this image is also disallowed then the entire military overview section of the article would lose any pictorial depiction of the way or manner in which the operation was conducted. Thus to sum up there is little chance to get a non free equivalent of the image, the image does not in any way diminish the commercial value of the original image if any, finally the image highly improves the readers perspective on the army tactics used during the military operation which the article describes; hence the image should be allowed under fair use claim.
