Upload to Commons[edit]

{{Admin-help}} There seems to be something odd about this image. It was originally uploaded as a free image by User:King03 (talk contributions). Then another editor converted it to a non-free image, and I'm not sure why, nor am I certain that it was the right thing to do. Perhaps User King03 should have directly uploaded it to Commons in the first place? Is there anything we can do to put this image on Commons as a free image so it can be used along with similar flags for similar purposes?:

Unless I'm missing something, which is very possible, putting this image on Commons as a free image is the right thing to do. – PAINE ELLSWORTH CLIMAX! 23:51, 4 April 2013 (UTC)[reply]

I doubt it. It's just not a simple enough drawing to stand as a free image (unless one gets the creator's permission). Therefore non-free seems the only method available. Commons would not take it.  Ronhjones  (Talk) 01:44, 5 April 2013 (UTC)[reply]

Please see above brief discussion.
The creator did give permission, as shown in the upload edit. That might be what is confusing me. If the creator had uploaded directly to Commons, instead of just to Wikipedia, that would have been the way to go, correct? If the creator uploads an image to Commons with a free/PD license, why wouldn't Commons take it? Commons has the other three flags and has had them for years. What else would an image creator have to do to "prove" that an uploaded image was created by him/her and is therefore free? – PAINE ELLSWORTH CLIMAX! 02:42, 5 April 2013 (UTC)[reply]
I seriously doubt User:King03 owns the copyright to a political party's flag; thus I also doubt he was in any position to publish the flag under free licenses. If he is indeed the copyright holder, he should send confirmation to OTRS via Wikipedia:Donating copyrighted materials. Huon (talk) 18:51, 6 April 2013 (UTC)[reply]
Please look again at the other three flags. They are party flags just like the one in question. They were uploaded from five to seven years ago under a free license. I still don't understand the difference between those flags and this one. – PAINE ELLSWORTH CLIMAX! 20:14, 6 April 2013 (UTC)[reply]
WP:OTHERSTUFFEXISTS. I have serious doubts about the other flags as well. Huon (talk) 20:25, 6 April 2013 (UTC)[reply]
Point taken. One of the Commons flags, the middle one with the hand, is presently undergoing a discussion about deletion. So far, it's a keeper. – PAINE ELLSWORTH CLIMAX! 23:15, 6 April 2013 (UTC)[reply]
Here is a link to the political party's webpage, where the flag is displayed. Thus I am doubtful that the uploader is the copyright holder of this flag. You can see the farmer image on the left, which the uploader likely took to Photoshop and added the green bars. This action does not mean he now owns copyright on the flag. Rather than nominate for deletion or list as WP:PUF, I converted it to fair use, as this way we get to keep the image. -- Dianna (talk) 04:10, 7 April 2013 (UTC)[reply]
Thank you very much for that, Dianna! Perhaps when I have more time, I'll see if the apparent owners of the flag's copyright will part with it. – PAINE ELLSWORTH CLIMAX! 04:44, 8 April 2013 (UTC)[reply]
