Semantics, but merchants are not allowed to charge different prices for merchandise/services. In some states, a merchant can elect to add a surcharge onto a customers bill for credit cards (not debit or pre-paid). The court ruling is that VISA needs to provide the ability to allow merchants to surcharge, there are several states that do not allow merchants to add surcharges: Currently, 10 U.S. states have surcharging restrictions including California, Colorado, Connecticut, Florida, Kansas, Maine, Massachusetts, New York, Oklahoma and Texas. Also, this isn't that relevant for cash back cards; if merchants elect to surcharge they have to use the same surcharge whether the card has rewards or not.
