Complaint against Anchorage judge Josie Garton

I am filing a complaint against new judge Josie Garton. She has ordered judgements against myself and my children’s father for two years consistently ignoring application of the Indian child welfare act and civil laws governing icwa Cina cases and procedures in the court of Anchorage, Alaska for two years . It has been clear that for two years Josie Garton cannot be objective or make objective non prejudice decisions and orders that comply with the law in order to justify removal of my Indian children. Judge Garton has consistently violated the law and violated Indian child welfare act. Up until her recently obvious and blatant, shocking misapplication of law and orders and actions make it clear that judge Garton cannot remain objective or be a judge on our case without making illegal, unjust orders that clearly disregard ICWA. Judge Garton has illegally Ignored my tribe Naknek Native village and refused to allow my sons only enrolled tribe to intervene and officially become a party to the case starting in May of this year. Naknek Native village was never notified by registered mail of the case commencing in 2019 which means when one or more tribes of the Indian children is not notified and told of their right to intervene the case must be dismissed and the children returned to the Indian parent. Judge Garton is fully aware of Naknek native village and has ignored, oppressed and refused to allow a native tribe their right to intervene and become a party to a ICWA cina case, she has knowingly ignored Naknek’s intervention and several motions naknek tribe has filed has been totally ignored and unanswered as if they never showed up and filed motions in our case.

   Judge Garton recently made her most shocking, illegal, immoral, most bazaar, unwarranted and unlawful, not traditional adjudication order which was 43 pages of hearsay backed up by no factual evidence or application of the law and included emotional , reputation destroying false statements and allegations that were so bazaar and untrue it is clear that judge gartons knowledge of Indian child welfare act is in question and her knowledge and understanding of civil cina law. If she did or does understand what the law means and what needs to be proven with clear and convincing, factual evidence and testimony by a qualified expert would need to be proven before making these kinds of decisions and judgments against us. Judge Garton has gone against an honorable judge ramgrens order in October of 2018 and gone against his lawful order that did consider the law and only allowed fact and proof and evidence into the court and dismissed all the emotional and disproven hearsay, judge ramgren made a just and honorable, lawful order in 2018 and judge Garton has dragged that hearsay and emotional and bazaar false , allegations all hearsay and placed it into a 2021 case and states and orders it as if it was lawful factual evidence as a justification for keeping our children from us today and in the future, judge Garton is using allegations that never occurred from 2014 up to 2016 and saying that things that occurred before our children were even born justifies a removal 7-5 years ago justifies a removal today. I have never seen this kind of behavior or emotional misconduct and unlawful behavior. Judge Garton is illegally keeping children from their parents today and not following any laws that are in place to be able to make this finding today. If you review or any judge reviews this case and judge gartons orders in this case would be shocked and it would be very clear that she is involved in unobjective, immoral unlawful violations of her code of conduct and ethics that judges are sworn to uphold. I am asking for an appeal, but for a thorough investigation. I do no believe I am the only victim or only case if judge Josie Garton is doing this to my family there is certainly more misapplication of the law occurring now and in her short career as a judge. The case needs to be investigated and I believe dealt with, it is scary to think that she has the power over other cases and lives to be so reckless and to go outside the confines of law and misapply it like this really puts her judgement now and in the future into question.
