Law System of Socialist Republic of Vietnam
[edit]Hello, In my view, I suppose that the content of the part named Law System of Socialist Republic of Vietnam would be very complicated. Because in Vietnam, there is not a formal definition of law system in the acts of law. It exists only the definition in the manual of the university. Therefore, the definition must be quite different from one to another manual. Consequently, I consider that it must be better if the main ideas of this part is just about the system of legislative documents according to the institution's competence as provide at art. 4 of Law on promulgation of legislative documents of 2015.
Based on this article, the system of legislative documents in Vietnam is provided as following - The Constitution which is voted by National Assembly and promulgate by the President; - Codes and Laws (referred to as Laws), Resolutions of the National Assembly; - Ordinances, Resolutions of Standing Committee of the National Assembly; Joint Resolutions between Standing Committee of the National Assembly and Management Board of Central Committee of Vietnamese Fatherland Front; - Orders, Decisions of the President; - Decrees of the Government; Joint Resolutions between the Government and Management Board of Central Committee of Vietnamese Fatherland Front - Decision of the Prime Minister; - Resolutions of Judge Council of the People’s Supreme Court; - Circulars of executive judge of the People’s Supreme Court; Circulars of the Chief Procurator of the Supreme People’s Procurator; Circulars of Ministers, Heads of ministerial agencies; Joint Circulars between executive judge of the People’s Supreme Court and the Chief Procurator of the Supreme People’s Procurator; Joint Circulars between Ministers, Heads of ministerial agencies and executive judge of the People’s Supreme Court, the Chief Procurator of the Supreme People’s Procurator; Decisions of State Auditor General; - Resolutions of the People’s Councils of central-affiliated cities and provinces (hereinafter referred to as provinces); - Decisions of the People’s Committees of provinces; - Legislative documents of local governments in administrative - economic units; - Resolutions of the People’s Councils of districts, towns and cities within provinces (referred to as districts); - Decisions of the People’s Committees of districts; - Resolutions of the People’s Councils of communes, wards and towns within districts (hereinafter referred to as communes); - Decisions of the People’s Committees of communes.
