Crimes and Witch Demeanors

This episode is replete with flash-backs introduced as evidence, reprising a large number of characters that had appeared heretofore in the series. It is probably not accidental that the episode was written and occurred in a year when the series was doing well in the ratings and financially, even though it's parent network was beginning to show signs of weakness.

Under the contract law arcana characteristic to Hollywood production studios and the relevant unions, this was likely one of the most expensive episodes in the eight season run of the Charmed franchise, since each appearance of a character once appearing in a credited guest star role, even if only as a photograph, requires the studio pay a minimum (union rates) actors fee for the photo, or film snippet. Being a union rate, this can be substantial money for salaries paid to people not on set or in studio, a much more expensive rate than extras or supporting guest actors playing minor characters.

As a former star of the series, Shannen Doherty while mentioned in this script as Prue Halliwell with evidence presented involving former co-star Andy Trudeau, is not depicted in this episode for that would have very expensive in relative terms for similar standard contract boilerplate terms. It should be understood, this situation is a multiple union arrangement, which cannot be easily set aside by negotiations with the guest players—in Hollywood, even the secretarial pool and accounting staffs are in the unions, so sub-standard pay arrangements would be outed and make problems for the production company.

The Haliwells' immediately go on the warpath and begin a fight to have the outcome reversed, initially summoning the Cleaners by deliberate acts that would expose magic if left unfixed. There confrontation proves inconclusive, and they learn their only recourse is to have a hearing in front of the mysterious Tribunal, which is a council that oversees all magic and made up of {{Demon}}s as well as {{Chrmdchar|The|Elders|p=Elders}}. Trivia

  • The episode title is a play on words to the film Crimes and Misdemeanors.
  • Another title used to promote this episode by The WB was Charmed on Trial.
  • Barbas returns in this episode once again; we learn that the last time the sisters vanquished Barbas, they didn't really vanquish him, they just imprisoned him in the Flames of Hell.
  • Phoebe lost the use of her individual powers in this episode. The Tribunal said that Phoebe would be stripped of her active powers but premonitions is known as a passive power. In this episode, the term 'active' is used to refer to Phoebe's "unique" powers, premonition, empathy and levitation. She retained her powers as a witch and a Charmed One, which enables her to continue to act as part of the Power of Three and cast spells. Phoebe earned back her power of premonition in Styx Feet Under. Whether or not she earns back her powers of levitation and empathy are unknown.
  • The WB promo for this episode uses clips of Piper from Coyote Piper, Phoebe from The Importance of Being Phoebe, Y Tu Mummy Tambien,Oh My Goddess and Paige from Y Tu Mummy Tambien. However, none of the clips shown, were used in the episode itself.
  • This is the beginning of Darryl's refusal to aid the sisters in their dilemmas.
  • Gideon's initial invocation to the Tribunal basically translates to "I say, behold this hour, for my wife will kill me."
  • Inspector Sheridan shares the same surname with Prue's co-worker and boyfriend Jack Sheridan from season two.
  • It appears that Paige's powers advance in this episode, when she says "orb away", making a coffee stand orb into nothingness. Presumably, the coffee stand was orbed to another location and didn't just disappear altogether.
  • Jenya Lano, who plays Inspector Sheridan, appears in her first Charmed episode.
  • Since a long time, in case of exposed magic, Prue's name and death are mentioned and is mentioned again in Something Wicca This Way Goes.
  • This is the Cleaners' second and last appearance on Charmed. Their first appearance was earlier in the season, in the episode Forget Me... Not.
  • The episode consisted of a series of clips from previous episodes mixed together with newer footage. First, Phoebe mentions Barbus trying to kill the sisters three times, and footage from From Fear to Eternity is played. Gideon testifies for the sisters saying that they never failed to keep "the big secret", in which footage from Womb Raider is played. Later, Barbus mentions how the sisters are always under the influence of something, in which more footage from Womb Raider is played, as well as footage from Bride and Gloom. A scene from House Call is used when Gideon defends the sisters, stating that despite being "under the influence" of something (evil or otherwise), they've always managed to cover their tracks. After questioning one of the Cleaners, Barbus brings forth clips from Magic Wears a Mask and Sam I Am to show how the sisters didn't always cover their tracks. Lastly, footage from Deja Vu All Over Again (Andy), Death Takes a Halliwell (Inspector Davidson), and Witch Way Now? (Agent Jackman) are summoned by Barbus when he mentions that Darryl isn't the only inspector to die in order to clean up the sisters' "magical messes".

this is also the last time we heard that phoebe used her premonition twice & both are forced premonitions...first when she saw the crime scene & second when she told paige that she see nothing with her date besides having sex...meaning she had her final premonition in this season twice & her empathy once when she tries to sense if sheridans was lying or not...

Of lasting consequence:
The Tribunal, spurred by Barbas, reverses their decision to kill Darryl when Leo and Chris show up with the possessed Inspector Sheridan and exercise the spirit Barbas had used to possess and control her, but they decide Phoebe must suffer the consequences for using her powers for personal gain and strip her of her active powers (premonitions, levitation and empathy). It is however a temporary punishment: she can earn her powers back if she and her sisters make good use of their magic.
Once Barbas and Gideon are alone, Barbas discovers that Gideon's worst fear is that someone discovers that he is the one after Wyatt, but Barbas says he won't tell a soul. In fact, with Gideon's greatest fear known to Barbas, the demon of fear, the producers are setting up a future episode's plot in the greater seasonal story arch.
In the backplot (series' fictional canon), the stress of this near death experience weighs on Darryl and helps him decide to move away from San Francisco during the summer between the seventh and eighth seasons. He appears in the latter solely as a character alleged to be talked to by phone– so his face or even his voice disappears from the series.
Chris' open hostility to Leo, and bad attitude still carries over to into the next few episodes, but is diminished when the two are forced to work together sleuthing through the underworld for clues as to how Barbas manipulated the start of the crises.
