Colin Delaney

Seeing as you were one of the ones that wanted it kept, could you help me watch it? People constantly are adding week-by-week events and just a general list of every loss he has had. It's getting very annoying. Just because he hasn't done much, doesn't justify adding every match to the article by default. Ohhhh God. Why does that welcoming message have to be so damn loving and cuddly? The user removed stuff from a page a page but because it was their first edit I assumed good faith, reverted and sent them a welcome message from Twinkle. BUT THE DAMN THING AUTOMATICALLY WENT AND THANKED THEM FOR THEIR EDIT! For bloody removing stuff! And now I can't remove the welcome message without looking like a dick. Not good. Tomas M Fleischmann

Tomas Fleischmann is 1 of only 123 survivors out of 16,000 children who went through Terezin Concentration Camp during WWII. Tomas' story is true and even more amazing as his book Lolli's Apple is told as an innocent 6 year old boy. I find his story more than notable however if anything requires editing, I am happy to consider any suggestions.

I have reviewed my statement in favour of deletion on Wikipedia:Articles for deletion/Tomas M Fleischmann and do not find it to have broken any guidelines or protocol. I stated the facts neutrally as I saw them: that according to Wikipedia's guidelines (as quoted exactly and linked to in my statement) the article is a valid candidate for deletion. I did so without reference to any editor, without stating or inferring any prejudice towards the article's creator and without any assumptions of bad faith. I see at Wikipedia:Articles for deletion/Liverpool vs. Dinamo Bucharest, European Cup Semi Final 1984 you are, like me, a non-football supporter who has strayed into that discussion! And we both feel the same way. I suspect our distance from the subject matter allows us to see it not as a match report, but as a nicely recorded piece of human history. Thanks for your comment! I certainly agree that maintaining an emotional distance is crucial to making objective observations on articles. It appeared that some editors on that AFD were letting their personal opinions get in the way of reason. By the way, I am actually a football supporter (and certainly not a Liverpool fan!) but I virtually never edit football articles and, as you say, simply strayed into that discussion. Copyright can indeed attach to the form of a list. But it is well established in US law that it does not attach to the content in a list such as this one. Happy to discuss the law here with you if you like, in greater depth. Also, as you may note, Gallup Polls and Time lists are commonly referenced by other publications, as are Academy Award lists, which reflects what the law in the US is in this regard. In no event may copyright extend to the facts themselves."[1] A screenshot of the list would, for example, be covered by copyright, but the mere listing of the fact of the 200 people chosen in the poll is not. Thanks for such an exact legal example. Is it basically an issue of information versus entertainment? The Israeli news group conducted a public poll and published the results as fact so copyright does not apply, whereas if (for example) a television station produced a "Greatest Israelis" show for entertainment purposes with an unspecified level of voting input from their audience then it would class as a creative list and be the TV station's intellectual property (and thus copyright)? The results of a poll are considered data. In the US, factual data is not subject to copyright. The most common court cases relate to things like phone book listings and used car re-sale prices. The general rule is that the form of presentation of the information is in fact subject to copyright protection. One can't just xerox the white pages of company x and re-use it, or the re-sale prices reflected in Blue Book x. But the information itself is not subject to copyright, so you can reflect any such list -- but not in the same format, as in a xerox or screen-shot.

The rule would be the same if the poll is one by the Academy Awards sponsor, or Gallup, or a newspaper, or a TV station. The key is that they are gathering factual data, and the data itself is not subject to copyright protection. It would not matter whether the poll related to entertainment or not.
