I uploaded this image as a request from AmiDaniel (talk · contribs) when we were updating Zarqawi's article after his death... it was used on the main page (for a couple hours), but then they (the Cabal, haha) switched to his mug shot... my question is this, the licensing tag you switched to reads It does not fall into one of the blanket fair use categories listed at Wikipedia:Fair use#Images, yet on that list is television and film screenshots... this is a direct screenshot from Zarqawi's own video, that was then released to the public domain by the US DOD... I do not understand why you switched the licensing tag... I understand if it is deleted because it is no longer being used, but am just confused by this new tag... please feel free to respond on my talk page... - Adolphus79 12:31, 12 June 2006 (UTC)[reply]

I didn't upload that image and I'm not very knowledgeable about copyright rules, but I'd like to point out that the note says: "The copyright holder allows anyone to use it for any purpose, provided that copyright statement and link to http://buecax.deviantart.com/ are maintained." Anyone can say that... there is no release from the author. DeviantArt artists (and I am one of them , BTW, see http://jossif.deviantart.com) clearly state their copyright and releases in the inages themselves. There is no such release for WP. The uploader has stated that the author has given him permission by e-mail, but has requested that copyright statement and link to http://buecax.deviantart.com/ are maintained. The latter does appear to have been a complication in terms of licence (?). See Talk:Woman/Archive_2#Artistic nude women and especially Talk:Woman/Archive_2#Image:Erleuchtung.jpg. You haven't looked carefully, I think. Here is the diff. The uploader, User:Reene says:

That is simpy not verifiable. Short of having a full disclaimer by the author on the image talk page, this image needs to be deleted. Or, better, a note on the source web page "This image is given with permission to be use at Wikipedia" will remove the doubt.
