Images

Hi, just noticed that you are adding images such as File:UK-Army-OF4.gif to living people articles. These images are non-free images and have no fair use rational for use on these pages. Keith D (talk) 12:40, 12 September 2012 (UTC)[reply]

Image permissions

OK, so I see that you're uploading and using a whole pile of UK government photos and calling Open Govt fair use on them. This is, it seems, not always the case. For example, the image of David Laws that you uploaded comes from the DfE website which is, I think, clear in that it requires specific per,ission to use rather than falling under any fair use rationale - the very link you give on the image page (https://www.education.gov.uk/help/legalinformation/a005237/use-of-crown-copyright-material) makes this very clear.

Trust me on this - I've seen something very similar happen recently (interestingly enough with UK government photos from the DfE) and it didn't end well for the user concerned.

I appreciate your efforts etc... but Inthink we'd be better off sticking with the images we have or ones that are very, very clearly copyright free. Blue Square Thing (talk) 19:06, 15 September 2012 (UTC)[reply]

Thanks for your concern however the images are fine as I know quite abit about the Open Government Licence. However you may ask for a freedom of information request from here: http://www.whatdotheyknow.com/select_authority?query=education&bodies=1&commit=Search and they will tell you the images are fine, legit, legal and therefore are fine with the rules of wikipedia. No, it's your responsibility, as the uploader, to deal with the specific requirement that the DfE (and other government departments) have made that their photography can not be used without specific permission. This has been shown to be the case previously. The licence you quote applies to information from the DfE website but, as the DfE page I've linked to above makes clear, not the photography. I suggest you look here: http://www.nationalarchives.gov.uk/doc/open-government-licence/ it does not say that photographs are exempt from the OGL meaning that I am allowed to use them. You could always email the administrator User:Jdforrester who created the page Commons:UK Open Government Licence as he is an expert on the Open Government Licence and knows what is legal or not!
