Although obviously no-one would spend it, it was legally a circulation coin. The legal limit to the number of commemorative coins the mint could issue had been met and this was the way to get it in. They were considered “numismatic items” but not “commenorative coins.” Commemorative coins by law have a surcharge on their sale.
