The shooting incident in Sai Wan Ho on November 11, 2019 refers to the "Remembrance Day Three Strikes", a strike, a student strike and a shopkeeper strike, initiated by some Hong Kong citizens on November 11, 2019 to express their dissatisfaction with the abuse of power and violence by the police, during which Traffic Police Sergeant Kwan Ka-wing shot a male student of the Hong Kong Institute of Vocational Education, Chai Wan, who was approaching him as he was clearing a roadblock in Sai Wan Ho.

Incident details

Nearby Tai On Building of Sai Wan Ho, there were a huge group of protesters at the intersection of Shau Kei Wan Road and Tai On Street. While they were trying to block the way, policemen arrived and tried to disperse the protesters. There was a masked young man-in-white walking out from the crowd and shouting at a policeman. The man once raised his hands showing that he has no weapon[1], but a traffic policemen point to his chest using a gun and pull him closer. There were two man in black trying to walk closer, and the police officer immediately shot his right chest[2]. A man in black fall on the ground, while another man in black was shot twice when approaching the first wounded victim. The man-in-white escape when the situation was in mess. Another policeman arrived in the scene and control the shot young man-in-black. The police officer who opened fire continue to alert with the gun, while another police officer used his baton to warn theby-passers and protesters.

There was a great area of bloodstain, and the police blocked the road of the surrounding roads. Some by-passers openly criticized the police for being murderer[3], while some of them who were on the way to work were angry with the action of the police. [4]One of the armed police officer used the gun to point at those by-passers[2] , while some other policemen yelled at the bypasser.[4]

After that, some riot police arrived and shot pepper spray to bypassers, which included many elderly[4]. They also arrested two people.[4]

The injury situation of the victim

While the young man who was shot once lost his cconsciousness, a police officer brutally pull his upper part of body[2] and shake his body[5]. The victims were sent to the hospital.

In 9:15 am, Hong Kong Hospital Authority (HA) revealed that the victim was undergoing an injury in Pamela Youde Nethersole Eastern Hospital. The abdomen of the man was shot, the right-side kidney and right-side liver were teared and the Portal vein was injured. [6]

In 10:00 am, HA revaled that the victim was in critical conditions [6].

The hospital once had to prepare for a liver replacement, while the doctor found difficulties in taking away the bullets from his body. A Nephrology expert highlighted that if the victim suffered from diabetes, the rate of kidney failure may be the double of other patients.[7]

Local Responses

Hong Kong Institute of Vocational Education (IVE) issued a declaration confirming the victim as a student of their Chai Wan campus. Vocational Training Council (the organizer of IVE) revealed that they were distressed and sad, and has written to the Security Bureau asking for a complete investigation of the incident[8]。

Salesian English School issued a statement condemning the police for their over-violence, usage of fatal weapon, indiscriminately repelling the citizens and indifference of life. They expressed serious concern and urged for an independent investigation. They also highlighted their distress and urged for insistence of the appeal with peaceful manner, and thus to protect oneself and others.[9]。

Overseas Response

Democratic Progressive Party

Taiwanese president Tsai Ing-wen openly criticize the Hong Kong government on Facebook, stating they should not shoot the people-without-weapon, while Beijing and Hong Kong government should respond by the promise of democracy and freedom instead of bullets.[10]

Kuomintang

Huang Xin Hua, who is a spokesperson of the party, expressed their concerns and urge for sensible communication between the government and the protesters.[11]

Constitutional Democratic Party of Japan

Yukio Edano, the party leader responded to the incident emphasizing that it is never acceptable for using the public power to shoot the citizens-without-weapon regardless of the political stance and constitution. He also urged the Hong Kong police to stop their over-violence and showd his respect to the Hong Kong democracy movement.[12][13]

Taiwan

The President of Taiwan, Tsai Ing-wen, criticized the Hong Kong government on September 11, 2019 that they "should not shoot at unarmed people, shooting will only worsen the problem" and "what Beijing and the Hong Kong government should respond to the people of Hong Kong is not a bullet, but a commitment to democracy and freedom."[14][15]

Amnesty International

Amnesty International Hong Kong says the level of law enforcement by the Hong Kong police has reached a new low. The chief executive of Amnesty International Hong Kong says he understands that the police must maintain public order, but now the police have seriously undermined people's right to assembly and freedom of political expression[16].

Follow up

The injured teenage met with reporters

Chow Pak-kwan was given a large number of Koala's March by Hong Kong people after his surgery.

On November 13, 2019, Chow Pak-kwan met with reporters accompanied by his father, lawmakers and lawyer. Chow first thanked Hong Kong people who cared about his injury, and joked that the Koala's March he received now are stacked as high as a person. He said the first thing he did after the surgery was to check the latest developments on the protests on the Internet, but he was worried that the news only showed more protesters injured by police brutality, and hoped the police would stop using unjust methods against citizens pursuing democracy. Chow stressed that his conviction would not be shaken by his injuries, saying,

A man can be killed by bullets, but not his faith[17].

Chow Pak-kwan also believes that the Hong Kong Government's lack of response is to blame for the worsening conflicts in Hong Kong, and urges the people of Hong Kong to treasure their democratic votes and vote in the 2019 District Council elections.

A large number of Koala's March were given as gifts by the public

When asked what he wanted to do the most after the surgery, Chow Pak-Kwan said that he wanted to eat Koala's March the most. As a result he received lots of Koala's March so he need to use an enlarged Red-white-blue bag to carry all Koala's March when he was discharged. [18]. As a result, Chow Pak-kwan was nicknamed "Little Bear Biscuits"[19]. In September 2020, Chow set up a foundation called "Bear Biscuits Paradise Project"[20] to help build a cosmetic school.

Hui Chi-Fung personally prosecuted police officer Kwan Ka-wing for shooting

On 23 January 2020, Democratic Party legislator Hui Chi-fung filed a private prosecution against Kwan Ka-wing, the traffic police officer who shot at demonstrators in Sai Wan Ho. [21][22]. Hsu said that the police force has not imposed any penalties or prosecuted any individual police officers for their illegal acts so far in the anti-amendment campaign[23]. On June 11, 2020, the court accepted three charges of "shooting, attempting to shoot, with intent to cause grievous bodily harm", "using a firearm or ammunition with reckless disregard for the safety of others", and "discharging or handling any firearm likely to injure or endanger any person", with a maximum penalty of life imprisonment. The maximum penalty is life imprisonment. Mr. Hui said this is the first time a police officer has been prosecuted for police brutality and the use of force, and he believes the verdict is significant. The court will later issue a summons to the police officer involved, who must defend himself and appear in court. He described the incident as significant and sent a clear message that police officers would be punished for excessive violence and would have to bear the personal consequences. He also said that the Department of Justice does have the power to intervene in cases, but if it believes in judicial independence, it should be left to the court to handle the case, otherwise it is suspected of harboring police officers[22].

Appear in Court

On June 2, 2020, a 20-year-old student surnamed Wu and a 21-year-old student surnamed Chow Pak-kwan, who was shot, were arraigned at the West Kowloon Magistracy on charges of obstructing a police officer in his office, attempting to rob and attempting to escape from lawful custody. Senior Magistrate Law Tak-chuen banned the media from publishing the names, photos, places of work and schools of traffic policeman Kwan Ka-wing, his wife and two daughters, which could reveal his identity. [24][25] Bail was granted to the two defendants and the case was adjourned to June 30 for further hearing.

Department of Justice intervention in private prosecution

On August 18, 2020, seven months after the private prosecution of the case was initiated, Hui Chi-fung, the Legislative Council Member who initiated the private prosecution revealed that he had received a notice from the Department of Justice that the Secretary for Justice, Teresa Cheng, had decided to intervene in the case, and that the prosecution would apply to withdraw the summons and apply to the court for a trial between the 20th and 28th of the same month, as well as requesting a waiver for the traffic police officer concerned to appear in court. He also questioned the Department of Justice's decision to shield the defendant and the public's right to bring a private prosecution under common law. Finally, Hui said that he would discuss with his legal team and did not rule out the possibility of applying for a judicial review in the near future[26].
