The Constitution of Wisconsin

[edit]

The Constitution of Wisconsin bans same sex marriage and civil unions - but does it ban domestic partnerships? —Preceding unsigned comment added by 122.148.207.230 (talk) 11:00, 7 March 2009 (UTC)[reply]

Opening paragraph

[edit]

The opening paragraph of this article formerly read:

Civil unions will be recognized in Wisconsin as of August 3, 2009 despite same-sex marriage and civil unions being banned by constitutional amendment and Wisconsin Statutes in 2006.

There were several problems with that lead. There is a narrow definition of "civil union" and a broad definition of "civil union". In the narrow definition, a civil union is identical to marriage in all but name. In the broad definition, a civil union provides some but not all the rights and obligations of marriage. The lead confusingly uses the two definitions in one sentence. In doing so, the article perhaps unwittingly editorializes on the matter more than it should. The lead, in effect, said, "Wisconsin will recognize X, despite X being banned by the Wisconsin Constitution."

It is the contention of the Wisconsin Legislature and the Governor that Wisconsin's domestic partnerships are not "A legal status identical or substantially similar to that of marriage for unmarried individuals", which the Wisconsin Constitution bans. Wikipedia, on the other hand, by using both definitions of "civil union" in the same sentence, without distinction, is saying that Wisconsin's domestic partnerships are a legal status that is banned by the Wisconsin Constitution. Either that was poor usage, or it was editorializing on a legal issue that may be decided in the courts.

So, instead of saying that Wisconsin's Constitution bans "civil unions", I have substituted the actual language of the Constitution. And because "civil unions" has both a broad and a narrow definition, I have substituted the less troublesome and more precise term "domestic partnerships", which is the term the act itself uses. — Walloon (talk) 18:45, 19 July 2009 (UTC)[reply]

Public Opinion Reformat

[edit]

Isn't the Public Opinion section misleading? The table shows "Same-Sex Marriage in Wisconsin" with a simple Favor/Oppose showing public opinion finally moved in favor in late 2013. However the notes to these polls indicate that many of the respondents that are lumped in with the "Oppose" actually favor civil unions. Being that this article is titled "Recognition of same-sex unions in Wisconsin" should we break these respondents out in more detail where possible? Thkie (talk) 19:57, 20 May 2014 (UTC)[reply]

I've made these changes as I believe it more accurately reflects the topic of the article. Thkie (talk) 13:30, 21 May 2014 (UTC)[reply]
