Military Occupation of Hawaii[edit]

Hawaii is not occupied militarily. Your insistence otherwise is ridiculous. You clearly do not understand what military occupation is. The burden of proof is on you to rebut the presumption of the de jure Hawaiian Kingdom's continued sovereignty over the Hawaiian Islands. In 1993, the U.S. formally acknowledged that there is no treaty of cession, plebiscite, or referendum to legally transfer sovereignty to the United States. All 49 U.S. states have a treaty of cession. Texas has the Treaty of Guadalupe Hidalgo, for example. If a treaty of cession was not needed for annexation, the U.S. would not have made two failed attempts to obtain one for Hawai'i, nor would U.S. Congress have passed U.S. Public Law 103-150 in 1993. Furthermore, case law precedent does not support the transfer of Hawaiian sovereignty to the United States through acquisitive prescription, which is the passage of time similar to adverse possession. The abundant history of protest in the Hawaiian Kingdom, against foreign takeover, forever negates this claim. Finally, 25% of the Hawaiian Islands is currently occupied by U.S. military bases.

Disruptive editing[edit]

You haven't made your case for the inclusion of Hawaii as a State under military occupation. You feel that no one else has made their case. That's fine. But we are kind of slipping into an editing war and it's time for that to stop. A request for a third opinion was made and you disagree with that. I have no problem leaving Hawaii up in the article during the mediation. If you wouldn't mind however to make that request on the articles talk page and also acknowledge that you have opted to use wp:rfm to attempt to resolve this so that is known to everyone. Your assertions that the others should be removed before Hawaii is however is way off base. While they should certainly be sourced with reliable sources to remain there is no reason they should be removed before Hawaii is. If you have in contention to their inclusion you should make it known on that articles talk page and allow others time to respond in kind. Fair? Actually now that you mention it other inclusions seem to need to be removed. If you will allow me to refer you to this http://en.wikipedia.org/wiki/Kashmir_dispute which is a border dispute or territorial dispute between China, Pakistan, and India. Gaza is recognized as independent of Israel where the lands in the Kashmir dispute are independent of neither of the 3 countries involved.198.45.184.25 (talk) 07:47, 19 January 2014 (UTC)[reply]

Thank you for your consideration. I just made the mediation request known on the article talk page, as per your suggestion. I understand your point about contesting the inclusion of other states on the list. However, would it be fair for me to delete a listing without providing reliable sources? I will respect the decision of the mediation committee as the final say in this dispute. Justice, the legal status of the Hawaiian Islands, and the lawful de-occupation process is my motivation. Just to allow you to know, I removed the Hawaiian Kingdom. I did so though only after concluding that you were backing out of mediation. So goes the mediation, so goes the agreement not to edit the page accordingly. On a personal level I think that people should be allowed a peaceful self determination. Whether that's Texas secession or the belief that Hawaii never could have legally become a state or even the Vermont republic and the Lakota Republic. I'm not fan of Texas v. White. People shouldn't have to go to war or contend with the tyranny of Majority to get out of this compact of States. There need be a system to do this peacefully.
