The wikipedia article on Pilger's film 'Utopia' has a link to this page.

It reads:

"Charlotte O'Sullivan of the London Evening Standard wrote that "what brings the material alive is Pilger's visit to Mutitjulu" where an Australian Broadcasting Corporation television programme in 2006 concocted an entirely fictitious story about a pedophile ring run by community leaders, which lead to police moving families off their land. "The final shocker is that the territory vacated turned out to be rich in minerals and is now being vigorously mined." ^[1]

This seems to imply that the Mutitjulu community was forced to vacate their land and that it was taken over by mining companies. There is nothing in this article about that. Can anyone add a comment to this article that throws light on O'Sullivan's claim?

There seems to be a massive difference between what the us constitution permits and what the USDOJ advises, whereas the USDOJ is not the law of the land the article has multiple deficits. In the sense that restraining orders are issued on a civil basis when in facts there is a remedy that exist by the criminal law, many states forbid the issuance of equity in the statutes-but activists demands otherwise. The rules of equity may vary from state to state, but most will tend to follow along the lines of an non-speculative irreparable harm that is imminent in absence of the issuance of equity, and that the moving party is likely to succeed upon the issuance of the injunction. One theme that was common prior to USDOJ involvement was constant dialog about how restraining orders were just a piece of paper, and they knew that the orders were without merit. Various activist in their delusional thinking wanted to criminalize equitable violations fully knowing that they knew were without merit and that all criminal violations result from an abuse of the trial court judge's discretion. For example, Equity enjoining party A from murdering party B will not have any merit because all states have prohibited murder as well as crimes for numerous other violent offenses, true threats ^[2], and fighting words^[3] when spoken face to face. Because of the criminal statutes, it would be improper for a petitioner to use the courts of equity. Suppose party A ran to the court house saying they are afraid party B will kill "A" and obtains an order barring contact, kicking "B" out of their marital home, and creating a floating buffer. The alleged harm with the remedy sought shows that the alleged harm is speculative and that it is not imminent, because if the alleged harm was real and imminent then no piece of paper would stop B from killing A where B knows where A is staying. If it was entirely B's home this creates the government seizing a persons property without compensation for private use, and if A was in the military that private use would be used to quarter a member of the military. So there are 3rd, 5th, and 14th amendment issues involved. The current article goes on to say, "All protective order statutes permit the court to instruct the abuser to stay a certain distance away from someone." However, this is not permissible under the first amendment. These floating buffers have been ruled unconstitutional in 1998 in Schenck v pro-choice network. I also find the current reading "(no one really knows what the law's stance if the abuser stays in one place and the victim moves into the area)" humorous in a way, but would be unconstitutionally vague if true. The order does not enjoin an unrestrained party, only those who are enjoined is restrained. The defenses, should a contempt issue be raised, may vary state per state, but if a person is charged criminally then constitutional defenses can be raised prior to the trial in a demurrer, or in jury instructions, or the jury may be left to decide intent. But prior to a violation, a party needs to seek judicial review as once a violation occurred in a contempt setting constitutional defenses are difficult even if the equity is unconstitutional-and most of them are and unconstitutional prior restraints ^[4]. There is at least one case where the supreme court has justified a person violating equity, ^[5]. There are other exceptions where litigators privilege rests, when carved into the order, and other exceptions within the states. Furthermore, using a court of equity to demand that a person pay mortgages would be something that ought to be decided through a civil tort as whereas there are fixed monetary damages equity would be improper. Moving back to the prior restraints,

and any judge issuing them may be prosecuted under 18 usc 242 ^[6] Even when an order is issued, which is usually in the context of violence Milkwagons Drivers Union, the order may not prohibit more speech than what is necessary to achieve the government's compelling interest otherwise it fails a test for strict scrutiny ^[7]. Not even a so-called right to be let alone from unwanted speech is a compelling governmental interest except for the captive audience, and even in a captive audience it is used only sparingly ^[8]. Thus blanket bans on non-commercial mailings are not legally permissible but commonly enjoined anyways,

However, phone calls and yelling into the home may be permissible to enjoin because of unwanted noises in the home Kovaks v cooper-although with the ubiquity of smart phones, and the ability to block callers, even phones may become exempt from the captive audience but it is best not to become the case law.
