California's 10th congressional district special election, 2009 will occur to fill the vacancy in California's 10th congressional district if Ellen Tauscher resigns her seat.

On March 18, 2009, Democratic United States House of Representatives Representative Tauscher announced that she had accepted the position of Undersecretary of State for Arms Control and International Security.[1] If she is confirmed by the United States Senate, she will have to resign her seat in the House, necessitating a special election to fill her vacancy.[2]

Procedures for special election

Following the same procedures as the 32nd district special election caused by the resignation of Hilda Solis to become United States Secretary of Labor, the Governor of California will have 14 days to call a special election following Tauscher's resignation, which will then be required to occur within 112 to 126 days. The special election will consist of an open primary among candidates of all political parties; if one candidate wins a majority of the votes, he or she wins with no further action.[3] If not, there is a general election between the candidates with the most votes for each party. Such a general election would take place eight weeks after the open primary.
