Images and other things

Hello, Caracas 2000.

"This images are part of the collection of the Vicente Emilio Sojo Foundation, they were published in a 1999 album of venezuelan aguinaldos of the XIX century, the publication of this images is legal, because are historic photos in Venezuela, promotional, and in the cd they don´t say the coypright status, i think they we can publish this photos in Wikipedia."

I assume you are talking about Image:Orfeón Lamas .jpg and Image:Orfeón Lamas 2.jpg. The image description pages for these images do specify that the source was a CD. However, there is no information about who the photographer is, when the photographs were taken, when they were published, or who the copyright holder is. We cannot assume that they are not under copyright protection just because there is no copyright notice. Copyright protection is automatic; no explicit notice is necessary.

These images currently state that they are licensed under the GFDL, but there is absolutely no evidence given that the copyright holder has licensed them this way. If you have evidence that they are indeed licensed under the GFDL, please provide this evidence on the image description pages, and write an explanation at Wikipedia:Possibly unfree images under the appropriate entries.

We must assume that these photographs are under copyright protection unless we have some good evidence to the contrary. Since they are under copyright protection, they must be freely licensed by the copyright holder (under the GFDL, for example), or we must use them here under a claim of fair use. In order to use them under a fair-use claim, the images must meet all ten requirements of the Wikipedia fair-use policy.

If you update the source or licensing information for these images, please make a note about your changes at Wikipedia:Possibly unfree images.

If you are not GJRFMorelligu, then I am sorry for the accusation. I know that Mr. Morelligu has at least two accounts on Wikipedia and is currently blocked from editing, so when you appeared after he was blocked and began to edit the same things he was working on, it aroused my suspicions. Yes, the source is fine. However, this image is copyrighted, and you are using it under a claim of fair use. Please read the fair-use counterexamples, especially number 7, which says that using magazine covers to illustrate an article about the person on the cover is not fair use. Orfeon Lamas photos

I buy the cd of Aguinaldos Tradicionales, in that cd are that images, and they don´t say the source, they only say that, the pictures of the cd are part of the archive of the Vicente Emilio Sojo Foundation, and that they published them in many albums.

The reason that Wikipedia needs the source of images is so that we can identify the copyright holder. In this case, the copyright holder is probably the Vicente Emilio Sojo Foundation, if that is the credit the CD gives. When you give the source of these images, say that they were scanned from an album, and make sure you say that they are credited to the Vicente Emilio Sojo Foundation. Remember that these images can be used on Wikipedia only under a fair-use claim, unless the copyright holder agrees to release the images under a free license. And unless you are using the images to illustrate the CD itself, an {{albumcover}} tag is not appropriate, because fair-use tags need to apply to how the images are being used, not where they came from.

For the source, you need to indicate the copyright holder. As I said, the copyright holder for these images seems to be the Vicente Emilio Sojo Foundation, if that's what the credits say in the CD. So for the source, just say that you scanned the images from an album, and that the album credits them to the Vicente Emilio Sojo Foundation.
Now, these images are copyrighted, so unless you know that the copyright holder has released them under a free license, we can use them here only under a fair-use claim. Which fair-use tag you use depends on how you are going to use the image. Okay. The biggest problem with these images is that they are currently tagged with a GFDL tag, but there is no evidence that the copyright holder (apparently the Vicente Emilio Sojo Foundation) has released the image under the GFDL. So we are claiming that this image is free for anyone to use for any purpose (because that's what the GFDL means), but it's probably not.
We must assume that the image is copyrighted and unlicensed, because we have no evidence to the contrary. So we can use these images on Wikipedia only under a fair-use claim. The first step is to determine whether these images meet all ten points of the Wikipedia fair-use policy. Carefully read all ten of these criteria. If you believe that the use of these images in the Orfeon Lamas article meets all ten, then you should use a fair-use tag.
There is a list of all fair-use tags at Wikipedia:Image copyright tags#Fair use. Choose a fair-use tag based on how the image will be used, not on where it came from. You are using these photographs to illustrate a musical group. There does not appear to be a specific tag for this, so you will probably need to use {{Fair use in|Orfeon Lamas}}.
If you use this tag, you must also write a fair-use rationale, which explains why the use of the image in the Orfeon Lamas article meets all ten points of the Wikipedia fair-use policy. WikiProject Albums conventions

Hey, it's not a huge thing, but I just edited a few album pages where you were the only user in the history log. You may want to see how I edited "your" pages (check my contributions or see the articles that you modified in the last day or two). Specifically, according to Wikipedia:WikiProject Albums, track names should be in quotes, and track numbers should use the # symbol. Otherwise, keep plugging away at all that Latin music. Hello again, Caracas 2000. I notice you've been inserting exactly the same fair-use rationale for many images. You are saying:

  • No free equivalent is available or could be created that would adequately give the same information.
  • The material must contribute significantly to the article, and must not serve a purely decorative purpose
  • the photo is only being used for informational purposes.

But let's consider, for example, Image:Galeron 1.jpg. This image is being used in the article The Galerón. Here it is simply illustrating a celebration that happens every year. A free equivalent image could certainly be created for this; all you have to do is attend the celebration and take a photo. So your fair-use rationale doesn't make sense.

The idea of a fair-use rationale is that it must explain exactly why each use of the particular image qualifies as Wikipedia:Fair use. A specific fair-use rationale must be written for each and every image. You cannot simply paste the same rationale into all images.

Hmm, Image:The Parranda of San Pedro.gif is interesting. I see that at the bottom of [1] it says, "Copyleft © 2005-2006, Algunos derechos reservados." But it doesn't say which rights are reserved. I can't find anything more detailed on the site anywhere, so I can't tell what license they are releasing their content under. License tagging for Image:Manzanares urbanization.jpg

You probably can't use the image on Wikipedia at all. The image is almost certainly copyrighted and unlicensed, so it would have to meet the stringent criteria of the Wikipedia fair-use policy. Caracas Pictures

I'm removing the two pictures you added to the Caracas article. The el hatillo one simply cannot be in wikipedia, it's copyrighted and used without permision from the author, it also contains a watermark which is not compatible with the wikipedia standards, if you want to use a picture of el Hatillo town in wikipedia please check the El_Hatillo_Municipality article and you'll find pretty good ones and all used under permision from the author, or you can simply go there if you live in caracas and take it, copyrighted images used without permision are only "acceptable" when it's almost imposible for someone to photograph the subject and it's extremely relevant to the encyclopedia for example Asociated Press pictures for recente relevant events. I would also like to point out that one picture representing the colonial architecture remaining in the city is enough, i don't think two images on the same subject should be in the main Caracas article, more detailed articles such as Petare and El_Hatillo_Municipality provide more pictures and information for those interested.

For the above reason i removed the Pico Oriental picture, while it is perfect for wikipedia, and a very good picture, i think oversaturating the article with pictures of the Cerro el Avila is too redundant, and since the article is about caracas i think Image:Altamira.JPG is more apropiate since it shows more city than the Image:PicoOriental.jpg which has a big plant leaf interrupting the picture and the roof of a house covering a considerable part of the composition.

El Hatillo map

Hi, I reverted your edit in El Hatillo Municipality because I had actually put the newer map on purpose. A user in Commons made an effort to make one map per Venezuelan municipality, and they all have a better quality than the one I made. You can see the maps in Category:Maps of municipalities of Venezuela. Hi there - You've been making various category changes to Venezuelan musicians recently, and I wanted to discuss the changes you've made. I'd like to draw your attention to the following:

Looking at your recent work, then, and in addition to the ones I've already mentioned, I'd disagree with your changes to Category:Venezuelan violists, Category:Venezuelan flautists, Fulgencio Aquino, Ignacio Figueredo, Category:Venezuelan harpists by genre, Fulgencio Aquino, Juan Vicente Torrealba, Humberto Bruni Lamanna, Edward Pulgar, and María Rivas (categorization).

I agree that we want to make Wikipedia the best we can make it, which is why I suggest that we both follow the guidance that other people have laid down, which I have set out for you in my previous message. This means that we don't have to decide for ourselves what is the "best thing to do" as we can just follow decisions made by others. In fact, your changes don't help other people find Venezuelan musicians as easily as they can find similar musicians of other nations using the categories. For example, Category:Violists by nationality now doesn't have an entry for Venezuelan violists because of the changes you made - click on this category and see for yourself. Hello again. I've undone some of your changes to articles that you've been putting back in this category. As I explained before, this category should not be used when the person can be correctly categorized in a sub-category of it, e.g. Category:Venezuelan classical violinists. Specific guidance about categorizing musicians is given at WP:MUSCAT under this headingArticles should be placed into as specific of a category as possible, always favor third-order over second, and second over first whenever the information is available. They should not be placed in a parent category and also one of it's sub categories, e.g., no placing an article in both Category:<N> <G>musicians and Category:<N> musicians, it's redundant. Putting people in Category:Venezuelan musicians and a sub-category also falls foul of the general Wikipedia guidance: WP:CAT#Some general guidelines #3: Articles should not usually be in both a category and its subcategory. Please discuss with me further if this is unclear. Also, in some of your edits, you got rid of {{DEFAULTSORT}}, probably by accident, but if you don't know what it does, I suggest you find out because it is very useful and removing it from an article causes problems. Santiago Mariño

Hi! I am writing to see if we can't work through our obvious disagreements about the status of Santiago Mariño and I certainly don't want to get in an edit war with you.

As far as I can see, Mariño briefly took power in a military coup and, therefore, took on the position and power of President, even though it might have seemed illegitimate to others. Unfortunately, as you know, this has been an all too common event in many countries, but even though the position is seized rather than won through the ballot box, the victor is usually considered to be "President." Is there, perhaps, some historical reason why this title should not be accorded to Santiago Mariño even though it is accepted for many other dictators? It is true that my knowledge of Hispanic-American history is rather poor these days as it is some 40 years since I studied it, and I don't have many references to hand - so perhaps I am missing something obvious - in which case I would be grateful if you could let me know what the problem is so I don't make a fool of myself. Any other suggestions you might have as to how we could resolve this difference amicably and/or make the article a better one would also be much appreciated. I look forward to hearing from you. Hi again! Thanks for your prompt note and clarification. I did not realise that Mariño "never took the head of the executive" which, if this is the case, makes it fair enough not to refer to him as a "president". I guess I had assumed too much: that if had seized power he would automatically be considered "head of the executive." I was really working from my memories from my youth in Trinidad (as I had no detailed sources available any more, having lost most of my old books during my many peregrinations) where we were taught to view Mariño as a great hero who launched his revolution from Trinidad with a handful of men and ended up becoming President of Venezuela. Ah well, history is often slanted! So, I thought I should let you know that I am happy to leave the article as you have edited it, with a "Military Man" Infobox. Thanks for your assistance here. Good morning! Well, it is a beautiful morning here now in the bush of Cape York Peninsula in far northern Queensland. I am sitting in bed with a cup of coffee looking out on our garden (we have almost no walls) where there is a mother wallaby and her joey eating our well-watered grass not more than 10 or 12 feet away, and I've just seen a pair of scrub hens strut by chattering to each other like an elderly couple and then I opened my computer and found your friendly note! Well, it is wonderful to be in paradise!
My interest in Mariño began when a band based on his invasion of Venezuela was part of the Carnival in Trinidad in the early or mid 1950s!! So I have been aware of him for a long time now! I was a kid then, and two of my close friends, children of Venezuelan refugees from the dreadful military dictatorship of Jimenez, were in the band.
I would love to get the list of Venezuelan "presidents" straightened out but, unfortunately, I am a long way from libraries where I might be able to check out such things. (I live over 300 km from the nearest traffic lights). So, I will have to leave it all up to you and others on the Venezuelan Wiki group. Good luck with it all! Cheers from Down Under! If you did not create this file yourself, you will need to specify the owner of the copyright. If you obtained it from a website, then a link to the website from which it was taken, together with a restatement of that website's terms of use of its content, is usually sufficient information. However, if the copyright holder is different from the website's publisher, their copyright should also be acknowledged.

As well as adding the source, we also need to know the terms of the license that the copyright holder has published the file under, usually done by adding a licensing tag. This particular page turns out to have mirrored content from the Spanish Wikipedia, and it seems that you created the article as a direct translation of that page. While this is okay, Wikipedia's contents are not public domain either, and you do have to give proper credit to meet the licensing requirement. I've given it in this instance (See my edit summary here and the template here), but in the future please make sure that any pages you translate are attributed.
