Fair Use Rationale for possibly nonfree images

I hope you can help me out. I have an article that I've uploaded photos (which I took) to amplify the article. The pictures are disputable as to whether any residual copyright attaches, even though the original artist of the subject photographed has donated the work for civic good. Because of the disputability, I attempted to put the photos on the U.S.-based Wikipedia servers -- not in Wikimedia Commons and that was accepted for a long time (two years or more). However, recently, somehow the photos got caught up and moved to Wikimedia Commons, where they were subsequently flagged and removed.

How do I get them back on U.S. servers with a Fair Use documentation attached? How do I prevent this from happening again? Bill Cupp (talk) (cool ASCII art ship missing here) 00:48, 29 February 2012 (UTC)

I thought so until I saw the part about this being a possible Langdon photo, since one has to assume he copyrighted all of his work. But--there's an Elizabeth Ashley photo from 1972 that has his backstamp on it but doesn't have any copyright markings.
My thought would be to go easy on this and try doing some more research on this Maharis photo regarding whether it can be found with a copyright mark. If you've found it in any collections like Getty Images and it has a copyright notation, then I'd say it's a non-free photo.
Maharis or his management probably provided the photo to the theater--it's also possible Marahis may own the rights to the photo and felt free to distribute it in this way. Bottom line--I'd do some more searching before moving this to see if you find any identical photos that indicate they're under a copyright of some kind. We hope (talk) 23:48, 1 March 2012 (UTC)

Had a go at archiving the page, but unfortunately it hasn't retained the content. But at least I have WebCite set up now so I can use it for other things. ok, this is it. I guess you could be right about the IP thing. Perhaps they're just allowing UK and Ireland users to view it. I think for a short time it wasn't possible to hear UK radio stations via the internet if you tried to access them from overseas, but that seems to have been addressed now. Glad it's all working ok. I guess that probably was their thinking with internet broadcasting, and actually Ireland also still has quite a large state-owned media, with just one commercial television station, so perhaps there's some correlation between that and their copyright laws and what can be accessed from different countries. Incidentally we still have the TV licence fee, which is currently £145.50 a year - though I'm not complaining (honestly). :) Thanks for the advice on WebCite and Tinypic by the way. Some good news on the Irish Times link. Somebody managed to find the original article, though I'm not sure how he actually did it. I've also managed to archive it with WebCite. Viewing it seems to work best with Google Chrome as, for some reason I can't seem to get it to focus properly in Explorer. Re broadcasting, I think infomercial insurance is a good way to see it. Most of the ads on our main channels tend not to be too bad, but some of the cable and satellite ones can be a bit cringe-making to watch, and there's some questionable radio commercials too. A couple of recent ones that spring to mind are a woman singing a love ballad to a jar of coffee and an add for a sugar substitute which I think was inspired by Chitty Chitty Bang Bang. :) Paul MacDermott (talk) 13:02, 10 March 2012 (UTC)

Good Find

File:Denver and Rio Grande train at Soldier Summit 1915.JPG, sweet. I found 2 copies of this photo (or at least an almost identical one) in books about the Rio Grande when I was researching to expand the article on Thistle, Utah. Oddly enough, I saw this photo for the first time a few hours ago at Mike Lynch Cartoons and considered uploading it... but too busy on other things. However, I was surprised you cropped it. I think it should include his wife since she adds much character to the photo. Her name is Ruth Owen Briggs. Life magazine renewals

Since you found an archive of Life magazine copyright renewals for some of the files in question on the CCI, and I subsequently noted that the U.S. copyright office online search page seemed to have missed a number of years, can you comment or check on this? Since you are the prime investigator for the Life images in question, some clarification about this would be helpful. The online copyright search at copyright.gov only goes back so far and doesn't take into consideration all copyrights filed since the office began. Only more current copyrights appear in their online search. The best place to start looking for older information about whether an item was renewed is here : Catalog of Copyright Entries. It's organized by year; search the year before as well as the year the renewal was due, as some companies filed before time was up. Their pages are trustworthy for the timeframe they deal with. OK, thanks for that. But your link source goes through 1977 only, and the online gov search starts from there, including 1978 and newer. When I noted that I found no Life renewals prior to 1985, I was using the online source. The text source apparently stopped being published in 1978 according to what a librarian told me. Since almost all of the Life images in question would have been renewed between 1978 and 1985, how do we handle that time period?

Copyright Act of 1976 no longer requires copyright registration. However, there are other ways that can make a magazine issue copyrighted:
  1. Copyright notice (proper): Form of copyright (Copr, Copyright, ©), Proprietor, and Year. Simple.
  2. If copyright notice is malformed or omitted:
    1. Registration before first publication or within five years after first publication
    2. No more than "relatively small copies" omit that notice; many other copies bear notice.
    3. "All rights reserved" or something similar — I think. In other words, omission of notice violates a written agreement that a copyright notice be beared.
So, if you want to inspect copyright of every magazine, use microforms, such as microfilms and microfiches. --George Ho (talk) 15:07, 17 April 2012 (UTC)

The quoted sentence above seems to be referring to the rest of the paragraph, which wouldn't relate to hundreds of Life magazines in general during the time period we're trying to focus on:

Failure to find a renewal record here does not necessarily mean that the book is in the public domain. Because of changes in copyright law, books published in 1964 or later, and many books that were originally published outside the US by non-American authors, do not have to register or renew in order to be copyrighted. (See the Library of Congress Website for details.) Also, it's possible for a number of works by a particular author, or published in a particular magazine, to be covered under one blanket copyright that may or may not mention the individual pieces by name. So when researching the copyright for a particular piece, you should know its author and publication history, and use this information in your record searches as well.

Thanks! And I'm going to suggest that in future, you copy the back of a photo as well as an uncropped copy, as in that Dick Clark photo, and then upload the "finished" version of it. There is a way to archive web pages. Internet Archive only crawls a very small number of sites when compared to the number of them on the net and some sites don't allow bots at all. With WebCite, you can archive a page and get a link to it; all it takes is a valid e-mail address. The only site I know that keeps their sold items online permanently with front and back displayed is a postcard site, CardCow.
My own "solution" to the PD or non-PD issue has been to consider everything as non-PD unless I can provide proof (link to the copyright renewal pages showing no renewal, date on the item for pre 1923, etc.) that there's no copyright or renewal. We hope (talk) 14:53, 17 April 2012 (UTC)

It is/was most definitely a publicity shot − it also appeared on official merchandise such as T-shirts until quite recently, and I notice the pic is still included on the Harrison online store page: http://www.georgeharrison.com/#/store/uk. Anyway, I'll post a comment on image's talk page as instructed, but I just wondered: if I were to upload the image from, say, this Harrison website (rather than scanning a page from a book, as I have done), does that get around the problem? You have licensed it as a copyrighted promotional photo--that makes it non free. The criteria for unacceptable use of non free photos for living persons is right here "Pictures of people still alive, groups still active, and buildings still standing; provided that taking a new free picture as a replacement (which is almost always considered possible) would serve the same encyclopedic purpose as the non-free image. Well, this photo has no copyright notice, yet the pictured subject, Susan Strasberg, was a one-time guest, and Mannix belongs to Paramount Television. I think you should remove the do not move tag as this is clearly a PD photo-sent out with a CBS logo on it and dated 1973 with no copyright marks on it front or back as can be seen from both uploads you made before the cropped version. Ask Magog to move it as his bot will move all of the versions of the file--not just the most current one.We hope (talk) 15:26, 11 June 2012 (UTC)

George, when you work with these newspaper files, you sometimes see that when the paper used the photo, they gave photo credit. When the photos have come from a television station or network, they always credit them and not the studio the show was done at unless it was the studio who sent them the photo. Hi. I noticed that there is only one file in the category. When I look at Wikipedia:Contributor_copyright_investigations/Wikiwatcher1#Uploads_to_en.wikipedia.org there are many "blue link" without a notice. Should they also be tagged? Finally, a Jo Stafford autobiography

I don't know if you've seen this, but a couple of days ago I found a Jo Stafford autobiography available through Amazon called "Songs of the Open Road: An Autobiography and Other Writings". Have been shopping on Amazon today and decided to buy myself a copy of Song of the Open Road. Amazon.co.uk had one left when I looked this morning, so I thought I'd go for it now and treat myself to an early Christmas present. It should arrive by 12-14 September, and it'll probably take me a couple of weeks to read it. I'll let you know how I get on and what I find as I read through it. Notes on book

Have just finished reading, and there's lots of stuff we can use, for the articles on Jo and Paul, and possibly a few others. Sadly nothing on the Grammys or Club 15, but several interesting anecdotes about Tommy Dorsey, Frank Sinatra and others from the Big Band era. Most of the material comes from their pre-1950s careers as the text seems to be taken largely from the work they did on their autobiography, but there's some later stuff. Also some information we have in their Wikipedia articles does not appear in the book; for example the earthquake at Long Beach High. Below I've listed some of the stuff I discovered:

  • Lots of stories about being "on the road" with the Tommy Dorsey orchestra.
  • A detailed chapter on how Jonathan and Darlene Edwards came into existence.
  • Some information on the early history of Capitol Records; how it got off the ground, etc.
  • Mention of two people for whom we currently don't have articles: Carlos Gastel (Stan Kenton's road manager), and Joe Kearney (road manager for the Bob Crosby band). I think Gastel ended up working in television, while Kearney went on to enter a seminary and studied to become a priest, who incidentally would later officiate at Paul and Jo's wedding. He also headed the Catholic Labor Institute. Not sure whether there's enough material around for articles, but worth a look.
  • One chapter titled The Ducks Are Drowning concerns a mishap on live television. Jo was performing against the backdrop of a specially built country scene with pond, and complete with ducks. A giant water wheel was supposed to create what I guess was meant to be a waterfall effect, but instead nearly proved disastrous for the poor ducks when a floor managers set the speed too fast.
  • The letters in the second third are from a period between March and September 1945 and detail a period when Jo and Paul were working on opposite coasts. They provide an interesting snapshot of their lives, as well as the world of the time. I think there may be a couple of good quotes in there, but will have to read through them again.
  • Some essays written by Paul Weston while he was Director of Music at Capitol. These include pieces titled The Hit Psychology and What Is Bop?
  • Correspondences between Jo and Johnny Mercer.
  • An article from the July 1945 issue of Band Leaders magazine concerning the appearance at La Martinique which has some great usable quotes.

I'll read through it again in the next few days and start adding some stuff to Jo's article. Also think there's enough to start a Jonathan and Darlene page so I'll do that. Thanks for the link. Interestingly Mile Nordif is mentioned in some of Jo's letters. I think at one stage he had romantic intentions towards her, but by then she was courting Paul Weston. I think you're right. We should include something somewhere. Just found a copy of Billboard Magazine from January 16, 1971 which appears to mention the album, but the text is a bit small to read. Ah, not so good in that case. :) Looks like there was definitely an earlier Tribute Records which I'm starting to think may have been dedicated to religious and inspirational music.
