License tagging for Image:Seth3.jpg[edit]

Thanks for uploading Image:Seth3.jpg. Wikipedia gets hundreds of images uploaded every day, and in order to verify that the images can be legally used on Wikipedia, the source and copyright status must be indicated. Images need to have an image tag applied to the image description page indicating the copyright status of the image. This uniform and easy-to-understand method of indicating the license status allows potential re-users of the images to know what they are allowed to do with the images.

Image copyright problem with Image:Seth3.jpg[edit]

Thanks for uploading Image:Seth3.jpg. However, the image may soon be deleted unless we can determine the copyright holder and copyright status. The Wikimedia Foundation is very careful about the images included in Wikipedia because of copyright law (see Wikipedia's Copyright policy).

The copyright holder is usually the creator, the creator's employer, or the last person who was transferred ownership rights. Copyright information on images is signified using copyright templates. The three basic license types on Wikipedia are open content, public domain, and fair use. Find the appropriate template in Wikipedia:Image copyright tags and place it on the image page like this: {{TemplateName}}.

Unspecified source for Image:Sethpubphoto.jpg[edit]

Thanks for uploading Image:Sethpubphoto.jpg. I noticed that the file's description page currently doesn't specify who created the content, so the copyright status is unclear. If you did not create this file yourself, then you will need to specify the owner of the copyright. If you obtained it from a website, then a link to the website from which it was taken, together with a restatement of that website's terms of use of its content, is usually sufficient information. However, if the copyright holder is different from the website's publisher, then their copyright should also be acknowledged.

As well as adding the source, please add a proper copyright licensing tag if the file doesn't have one already. If you created/took the picture, audio, or video then the {{GFDL-self}} tag can be used to release it under the GFDL. If you believe the media meets the criteria at Wikipedia:Fair use, use a tag such as {{Non-free fair use in|article name}} or one of the other tags listed at Wikipedia:Image copyright tags#Fair use. See Wikipedia:Image copyright tags for the full list of copyright tags that you can use.

I notice the 'image' page specifies that the image is being used under fair use, but its use in Wikipedia articles fails our first fair use criterion in that it illustrates a subject for which a freely licensed image could reasonably be found or created that provides substantially the same information. If you believe this image is not replaceable, please:

Go to the image description page and edit it to add {{Replaceable fair use disputed}}, without deleting the original Replaceable fair use template.
On the image discussion page, write the reason why this image is not replaceable at all.

Alternatively, you can also choose to replace the fair use image by finding a freely licensed image of its subject, requesting that the copyright holder release this (or a similar) image under a free license, or by taking a picture of it yourself.

It sounds like you might misunderstand what "free" means in this context. By "free", I mean that the picture can be copied, distributed, and modified for noncommercial or for commercial use, not that someone doesn't have to pay to see the image. For more information about the difference, there's an article at Gratis versus Libre. Unless it's explicitly stated otherwise, pictures are automatically copyrighted and unfree since the photographers retain copyright over the images. Although you may not live in California, there are a couple ways to get around this. If Swirsky has some form of contact, you can request that he release one or more pictures freely by modifying one of the requests at Wikipedia:Example requests for permission. If he declines, it may also be a good idea to put a picture request template on his article's talk page (just let me know and I can add it for you) and add his name to Wikipedia:Requested pictures#People. Since there are Wikipedians in California, someone can hopefully take a picture of him the next time he makes a public appearance. ShadowHalo 02:04, 10 February 2007 (UTC)[reply]

Thank you for the advice. I have sent Mr. Swirsky a copyright request form that I got from the page that you suggested. He has sent it back in agreement and I have reuploaded these two files With-George-martin-with-copyright.jpg and SethPubPhotowithcopyrightinfo.jpg with the copyright request form information. Seth Swirsky article[edit]

What I said on Talk:Seth Swirsky a few hours ago was true: I had never heard of him before today. I'm a participant in the Wikipedia:Third opinion project, and when I saw the article come up on the history there it was my first sight of the name.

His Real Clear Politics article, "Why I Left The Left," really rang some bells for me. If Swirsky's political perspective interests you, you might like to have a look at two other articles with similar themes:

The Phil Vassar version of the Paul Brandt song is more notable; there was a previous discussion that said the Phil Vassar/Paul Brandt song should have the title "Love Is a Beautiful Thing" on the article.
